NEW DELHI: The govt Tuesday relented to opposition parties’ unanimous demand for a debate in Parliament on SIR, albeit under the broader subject of election reforms, as the two sides reached an agreement to rule out the grim prospect of another session washout.The govt prevailed on the opposition to first take up a discussion on Vande Mataram in Lok Sabha on Dec 8. The debate on election reforms will take place on Dec 9, parliamentary affairs minister Kiren Rijiju said, adding that 10 hours each have been allotted for the two debates, with the possibility of extension. 12 NAGPUR: Half a century passed bearing a trauma that had revolutionised anti-rape laws in India and saved thousands of identities from being exposed to shame, but when TOI’s story on her plight put her back on the spotlight, Mathura forgot about her hardship and sought help for her two sons.On Tuesday, when Chandrapur district collector Vinay Gowda stepped into her ramshackle home in a tiny hamlet in east Maharashtra and wanted to know how he could help her, she demanded nothing, only jobs for her sons.Gowda and his team, surprised by her selflessness, have now begun planning contractual openings or business grants for her sons. “The younger of the two seemed proactive. We can think of helping him start a shop or a goat-rearing business,” said Gowda, who handed over a cheque of Rs8 lakh to Mathura. The cheque was given to the bank manager, who was in Gowda’s team.”The cheque has been deposited and a fixed deposit opened, which would need the tehsildar’s nod to encash. She would now get Rs5,000 per month as interest,” said Gowda, who reached Mathura’s home amid his tight schedule on a polling day in the district.Gowda further stated the govt would extend a grant under Pradhan Mantri Awas Yojana to build a home at the same place, where Mathura lives. The gram panchayat would carry out the construction, said the collector, who also deputed a person to coordinate and monitor her requirements.Gowda stated he’s also contemplating helping Mathura get land under a scheme for the tribal population. “Up to Rs 20 lakh grant can be allocated for 3-4 acres of land,” said the collector, adding her ration card has been updated to ensure 30kg of grains, while benefits under the Niradhar Yojana would resume too.Mathura’s custodial rape in 1972 triggered nationwide protests and ushered legal reforms. Delhi high court NEW DELHI: The protection enjoyed by a woman under Code of Criminal Procedure (CrPC) is not available in proceedings related to Foreign Exchange Management Act (Fema), which is governed by civil law, Delhi high court has ruled.Justice Neena Bansal Krishna dismissed a writ petition filed by a 53-year-old Canadian citizen challenging ED summons issued under Fema Section 37 for recording of her statement, rejecting the contention that safeguards guaranteed to women under CrPC applied to such summons.The petitioner argued that she could not be compelled to appear at the ED office and her statement must be recorded at her residence. She cited CrPC Section 160(1), which prevents women from being required to appear at places other than their residence for investigation. However, the HC highlighted that Fema investigations were civil-administrative proceedings, not criminal inquiries, and therefore, the gender-based protection available under CrPC could not be invoked.“The PMLA and the Fema have distinct statutory frameworks and nature of proceedings. Section 50 PMLA confers criminal investigative powers on ED involving summons for inquiries related to money laundering, which is a scheduled offence under PMLA and involves criminal prosecution. In contrast, Section 37 Fema is primarily concerned with civil-administrative investigations of foreign exchange contraventions governed by a regulatory framework distinct from criminal law. Secondly, there is a difference in the scope of summons and procedural safeguards,” the court said.“Civil code contains no provision like Section 160 CrPC mandating the recording of the statement of a woman at her residence. Section 50 PMLA confers criminal investigative powers on ED involving summons for inquiries related to money laundering, which is a scheduled offence under PMLA and involves criminal prosecution. In contrast, Section 37 Fema is primarily concerned with civil-administrative investigations of foreign exchange contraventions governed by a regulatory framework distinct from criminal law. Secondly, there is a difference in the scope of summons and procedural safeguards,” the court said.“Civil code contains no provision like Section 160 CrPC mandating the recording of the statement of a woman at her residence. The Supreme Court has issued a warning to the Association for Democratic Reforms for making unsupported allegations regarding the Election Commission’s methods in validating voter lists. During the proceedings against the legality of the Special Intensive Revision (SIR), the court encouraged a focus on legal frameworks rather than political posturing or speculative assertions about BLO suicides.  NEW DELHI: Supreme Court on Tuesday told ‘Association for Democratic Reforms’ to argue within legal confines while challenging the validity of SIR of voter lists across states and without reciting snide remarks of political parties, after its counsel Prashant Bhushan referred to EC as a ‘despot’.A charged up Bhushan reeled off a set of accusations — SIR is an unprecedented exercise for de novo preparation of voter lists which is impermissible under Representation of the People Act; and an unholy hurry to complete the exercise within a short period has put BLOs under “immense mental and physical strain leading to 30 of them committing suicide”.“A lot of people see EC as a despot as it does not care for the statutory provisions, rules and regulations, and whimsically carries out whatever it feels to be appropriate,” Bhushan said.A bench of CJI Surya Kant and Justice Joymalya Bagchi immediately cautioned Bhushan not to deviate from his legal pleadings. “There is no point in making sweeping remarks against EC relying on snide remarks made by political parties (opposed to SIR). Confine your arguments to the legal issues (raised in your petition) to challenge the validity of SIR,” the bench said.Bhushan said SIR was a ruse for EC’s game plan to verify citizenship of residents in constituencies across country. He said citizenship is determined by a competent authority under ministry of home affairs and that EC has no role in this exercise.Earlier in the day, advocate Ashwini Kumar Uadhyay had alleged there were repeated instances of assault and use of criminal force to intimidate BLOs engaged in SIR work in Bengal and other states, and sought a direction from SC to allow EC to requisition the armed forces and state police for preparation of a correct voter list. The Supreme Court has issued a warning to the Association for Democratic Reforms for making unsupported allegations regarding the Election Commission’s methods in validating voter lists. During the proceedings against the legality of the Special Intensive Revision (SIR), the court encouraged a focus on legal frameworks rather than political posturing or speculative assertions about BLO suicides. NEW DELHI: Supreme Court on Tuesday told ‘Association for Democratic Reforms’ to argue within legal confines while challenging the validity of SIR of voter lists across states and without reciting snide remarks of political parties, after its counsel Prashant Bhushan referred to EC as a ‘despot’.A charged up Bhushan reeled off a set of accusations — SIR is an unprecedented exercise for de novo preparation of voter lists which is impermissible under Representation of the People Act; and an unholy hurry to complete the exercise within a short period has put BLOs under “immense mental and physical strain leading to 30 of them committing suicide”.“A lot of people see EC as a despot as it does not care for the statutory provisions, rules and regulations, and whimsically carries out whatever it feels to be appropriate,” Bhushan said.A bench of CJI Surya Kant and Justice Joymalya Bagchi immediately cautioned Bhushan not to deviate from his legal pleadings. “There is no point in making sweeping remarks against EC relying on snide remarks made by political parties (opposed to SIR). Confine your arguments to the legal issues (raised in your petition) to challenge the validity of SIR,” the bench said.Bhushan said SIR was a ruse for EC’s game plan to verify citizenship of residents in constituencies across country. He said citizenship is determined by a competent authority under ministry of home affairs and that EC has no role in this exercise.Earlier in the day, advocate Ashwini Kumar Uadhyay had alleged there were repeated instances of assault and use of criminal force to intimidate BLOs engaged in SIR work in Bengal and other states, and sought a direction from SC to allow EC to requisition the armed forces and state police for preparation of a correct voter list. NEW DELHI: Supreme Court on Tuesday asked EC to ‘sympathetically’ consider Kerala govt’s request for extending the deadline for completion of SIR of state voters list by a week beyond the conclusion of local body elections on Dec 13.A bench of CJI Surya Kant and Justice Joymalya Bagchi told Kerala govt to submit a representation to EC within 24 hours and asked EC to consider it sympathetically and pass an order within 2 days of receiving the request for extension.Kerala govt had sought deferment of SIR in the state till Dec 21. But EC, through senior advocates Rakesh Dwivedi and Maninder Singh, informed the bench that as of Nov 30, over 98% enumeration forms have been distributed and over 81% have been digitised.Dwivedi said of total 5.5 lakh govt employees, Kerala govt has allotted 25,468 govt servants as BLOs for SIR exercise and another 1.76 lakh personnel for smooth conduct of local bodies elections. Since the two sets of personnel have been assigned different kinds of work and there is no overlap, neither SIR nor local bodies elections would get impacted, he said.Kerala SEC, which is conducting the local bodies elections, also informed the bench that there had been no hiccups in the ongoing process and that on conclusion of elections on Dec 13, the personnel assigned for the purpose will be free to resume their official duties.Singh said since EC and SEC are experiencing no problem in conducting SIR and local bodies polls simultaneously, Kerala govt should not have any problem either. Government clarifies users can delete the Sanchar Saathi app, intended to combat cyber fraud, despite initial mandates for pre-installation. Minister Scindia assures no snooping or call monitoring, emphasizing the app’s role in verifying IMEI numbers and tracing stolen phones. NEW DELHI: A day after a furore erupted over its decision to mandate pre-loading of state-run Sanchar Saathi app on all new smartphones, the govt softened its stance on the matter, saying that users are free to delete the application if they do not want to have it on their devices.Amidst concerns around state surveillance and violation of user privacy due to the mandated installation of the app, Communications Minister Jyotiraditya Scindia emphasised that the fears were unconfounded and added that the app was to protect the users from cyber frauds. “If you want to delete it, then delete it,” Scindia told reporters outside Parliament after the opposition Congress also raised the matter. “But not everyone in the country knows that this app exists to protect them from fraud and theft.” Dismissing the charges of the Opposition, Scindia asserted that there is no chance of snooping or call monitoring through the app. “It is our responsibility to make this app reach everyone. If you want to delete it, then delete it. If you don’t want to use it, then don’t register it. If you register it, then it will remain active. If you don’t register it, then it will remain inactive.”However, the Nov 21 order of the department of telecom (DoT) mandates the pre-install of the app under the Telecommunications (Telecom Cyber Security) Rules, 2024, and its further amendments. Not doing this will lead to action under the Telecommunications Act, 2023, the Telecom Cyber Security Rules, 2024 (as amended). Also, the govt order had clearly mandated not just the pre-installation of the app but also instructed that “its functionalities are not disabled or restricted.” So whether users will be allowed to delete it — and remove it from the device — still remains a question.However, govt sources said that the phrase — “ensure that the pre-installed Sanchar Saathi application is readily visible and accessible … and that its functionalities are not disabled or restricted” –is a direction to manufacturers, and not a restriction on users. “It simply means manufacturers must not hide, cripple or pre‑install a non-functional version of the app and later claim compliance. Nowhere it has been mentioned in the above clause that the Sanchar Saathi App cannot be uninstalled by the end user. It is up to the citizen if he wants to enable and register Sanchar Saathi Mobile App or wants to uninstall it. Users remain free to uninstall or delete the Sanchar Saathi if they do not wish to use it, as clearly clarified by the govt.”The move has already seen critics find a parallel to a similar mandate issued by the Russian govt in August requiring pre-install of state-backed messaging app, MAX. Scindia, however, denied the Opposition’s charges, and dismissed fears that it was an app for snooping. “There is no snooping on the basis of this, nor is there any call monitoring. If you want, then activate this. If you don’t want to, then don’t activate it.”The Minister claimed that Sanchar Saathi is an app and a portal on the basis of which a smartphone owner is able to protect their devices. “This is a step towards public participation. In this, people should not object, people should welcome. On the basis of this, when you buy a mobile phone, on the basis of that, whether the IMEI number is fake or genuine, you can recognise it on the basis of the Sanchar Saathi app.” The minister said that there have been more than 1.5 crore downloads of the Sanchar Saathi App, and added that to date, approximately 2.75 crore fraudulent mobile connections have been disconnected, and approximately 20 lakh stolen phones have been traced. MUMBAI: SC Monday rejected a petition challenging the validity of the delimitation exercise for zilla parishads, panchayat samitis and other local bodies in Maharashtra and orally observed it would not allow litigation aimed at stalling the electoral process.“We’re not going to entertain any plea that could delay polls,” said a bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi Monday. The bench orally remarked the pleas seemed to be a ploy to delay local body polls. SC had earlier set a deadline of Jan 31 for such polls to conclude and said there could be no further impediment in the conduct of elections.The challenge was following a Bombay HC order which had found no illegality in the decisions taken by divisional commissioners over delimitation for Kolhapur, Satara and Sangli, the core dispute in the plea. NEW DELHI: Supreme Court Tuesday said intruders and illegal immigrants have no legal right and hoped every citizen is aware of this problem in northeastern and eastern states, amplifying a concern that had prompted SC in 2005 to observe that Assam faced “external aggression and internal disturbance” due to influx of Bangladeshi migrants.Dealing with a habeas corpus plea on whereabouts of five Rohingya illegal immigrants untraceable after their detention, a plea strongly opposed by solicitor general Tushar Mehta, a bench of CJI Surya Kant and Justice Joymalya Bagchi took exception to petitioner Rita Manchanda’s counsel referring to Rohingyas as “refugees”.India’s poor have priority over illegal migrants: SC The CJI said the apex court was adopting a humane approach towards them. “Once these illegal migrants are in India, they claim right to food and shelter and help for their children. We have many poor people in the country. They have a right over the country’s resources, not the illegal migrants. True, the illegal migrants cannot be subjected to custodial torture,” the CJI said.SC’s remark came amid growing demand from certain quarters to recognise Rohingyas — Muslims based in the Rakhine province of Myanmar who are considered by the junta there to be Bengali intruders and not Myanmarese citizens — as refugees. There have been instances of Rohingyas trickling into West Bengal from Bangladesh where they have been living after escaping Myanmar.Mehta said in the guise of a habeas corpus petition, the petitioner seeks to know the details of process followed for deportation of Rohingya, the talks India had with countries on this issue, and disclosure of the contents of files on this issue. The bench adjourned the hearing to Dec 16, when other matters relating to Rohingya illegal migrants would be taken up.In its 2005 judgment in the Sarbananda Sonowal case, SC had said, “There can be no manner of doubt that the state of Assam is facing ‘external aggression and internal disturbance’ on account of large-scale illegal migration of Bangladeshi nationals. NEW DELHI: Rajya Sabha on Tuesday returned to Lok Sabha the Manipur GST bill, which replaces an ordinance to implem-ent GST reforms in the state, with finance minister Nirmala Sitharaman asserting that the bill will benefit people and businesses. She also hit out at the opposition. “Throughout 2024, we saw the opposition shedding crocodile tears about Manipur for everything. They raised issues, they voiced their concerns, and shed crocodile tears. I have seen it earlier as well — when we brought the bill for Manipur’s budget, the opposition did not participate in the debate. Even at that time, they didn’t think about the welfare of the people of Manipur,” the finance minister said.As the discussion on the bill was initiated, opposition parties staged a walkout over the govt not providing a timeline for a discussion on SIR. The treasury benches insisted on having first a scheduled discussion on 150 years of Vande Mataram after which a discussion on “electoral reforms” could be taken up.“Even today, when we are trying to convert an ordinance into a regular bill and get it passed here to become an Act, the opposition is not here to participate,” she said while replying to the discussion in the upper House, a day after the bill was cleared by Lok Sabha. “So, all the grievances that they voice about Manipur, accusing the PM and the home minister, is all just drama. I am ashamed and sorry to say this. SRINAGAR: J&K deputy CM Surinder Kumar Choudhary has moved Delhi high court against multiple social media channels, accusing them of falsely identifying him as one of two voices in an audio clip of a conversation with “sexual undertones”.Choudhary’s counsel, Suhail Malik, told TOI that several YouTube channels had been amplifying the audio with a static image of the deputy CM to suggest the male voice in the conversation with an unidentified woman is his.”An audio clip between two individuals is being circulated with his picture and passed off as his. These are small YouTube channels with fewer than one lakh subscribers,” Malik said. “We approached Delhi HC to get this taken down. ANI photo CHANDIGARH: A day after Inderpreet Singh, alias Parry, a one-time trusted aide of gangster Lawrence Bishnoi, was gunned down on a Chandigarh street, two audio clips, purportedly of Goldy Brar, Lawrence’s rival, were released Tuesday containing a threat to kill Lawrence to avenge the murder, intensifying fears of a gang war.While police are verifying the authenticity of the audios, Parry’s family says he was murdered because he wanted to quit crime. “He was acquitted in eight of the 12 cases against him. He got married on Nov 13 and wanted to start life afresh, leaving the life of crime behind. But the Lawrence gang was not happy with his decision. Parry’s unwillingness to be associated with Lawrence or any other gangster was the main reason behind his murder,” said a relative.“We are affluent. We don’t need his crime money,” added another relative.“Losing her newly-married son has sent Parry’s mother into a state of shock,” said Harneet Singh, Parry’s brother, an ASI with Punjab police. Parry’s father retired as a Punjab police inspector.Talking to TOI over the phone, Parry’s brother said Lawrence was a frequent visitor to their house, and would often stay overnight. Mourning his brother, he said, “My mother would feed Lawrence like a son and he repaid her love by killing Parry.”Recounting his last few hours, Parry’s kin said that on the day of the murder, he left to drop his bride somewhere around 4pm. When he returned, he received a call from one of his friends and left home again. He met some friends at a club in Sector 26 and that is when he received a call from Lawrence, who called him to the nearby timber market to discuss a “personal issue” and said his associates will accompany him, said his family. When he reached the designated spot, he was shot dead, they said.It tallies with what the audio clips say. A voice purportedly of Goldy claims Lawrence called Parry on the phone on Monday, congratulated him on his wedding and said he needed to discuss a personal matter. “He asked Parry to come to a place in Sector 26, saying some of his gang members would meet him there and it would be safe to talk on the phone. The Bombay high court has halted the announcement of first-phase municipal poll results, scheduled for December 3rd. PTI photo NGAPUR: The Nagpur bench of Bombay high court on Tuesday restrained Maharashtra State Election Commission (SEC) from announcing the results of first phase of municipal council and nagar panchayat polls on Dec 3, a day after polling, on the grounds that it may “prematurely disclose public mood”, and influence the next round of voting scheduled for Dec 20.A division bench of Justices Anil Kilor and Rajnish Vyas ordered that entire counting process should be held only after the second phase, and all results must be announced together on Dec 21. The bench held that declaring the first phase results within 24 hours would compromise electoral fairness. “This may materially affect the results of polls on Dec 20. Then, it cannot be said elections on Dec 20 would be held in a fair and transparent manner,” it said.The court also prohibited publication or broadcast of exit poll outcomes till voting ends on Dec 20. The model code of conduct will be in force till combined results are declared, the bench further said.The order came while hearing three petitions — filed by Shakil Hamid Mansuri, Ashwini Burde and Sachin Chute — challenging SEC’s move to defer elections in certain civic bodies, where appeals are pending over acceptance or rejection of nomination papers. The petitioners argued that the revised schedule had fractured the uniformity of the electoral process and risked giving an unfair advantage to some candidates.Under the original programme, all municipal councils and nagar panchayats across Maharashtra were scheduled to vote on Dec 2. More than 15 locations have already crossed that mark.According to the Central Pollution Control Board (CPCB), the city’s 24-hour average AQI at 4 pm stood at 372, rising from 304 on Monday and 279 on Sunday. Delhi Air Pollution Protest At India Gate Turns Violent Amid ‘Madvi Hidma Amar Rahe’ SlogansOut of 39 monitoring stations, 16 recorded readings above 400 — a level known to seriously impact health. Stations in the ‘severe’ category included Burari, Anand Vihar, Mundka, Bawana, Vivek Vihar, Rohini, Sonia Vihar, Ashok Vihar and Punjabi Bagh. The Air Quality Early Warning System for Delhi said the city’s AQI is expected to remain in the ‘very poor’ range over the next few days, with mist or haze likely during the night.Weather officials said surface winds are likely to blow from the southwest at calm to light speeds, picking up slightly in the afternoon. The sole survivor of a Saudi bus accident, Mohammed Abdul Shoaib, recounted how a tanker struck their vehicle, causing it to erupt in flames and kill 45 passengers, including his family. (Picture credit: PTI) NEW DELHI: The only survivor of the November 17 Umrah bus accident in Saudi Arabia returned to India on Tuesday and described the moments before the vehicle went up in flames, killing 45 other passengers. Mohammed Abdul Shoaib said the bus was travelling towards Madinah when a passenger asked the driver to stop for a toilet break. “As the driver stopped the bus, it was struck from behind by a tanker,” he said, as per ANI.Shoaib recalled that the driver escaped through a window immediately after the crash and “didn’t try to help any of the passengers”. As the fire spread rapidly, Shoaib managed to climb out of the same window, but his clothes had already caught fire. “There were 46 passengers on the bus, including me. Everyone else died,” he said, adding that his father, mother and maternal grandfather were among the victims.“I have no support left now. That is why I request the Telangana government to give me a government job,” he appealed.The group was part of a 54-member team that had flown from Hyderabad on November 9. Eighteen members of one extended family were among the dead. Shoaib survived only because he was seated beside the driver when the bus collided with the fuel tanker and burst into flames around 1.30 am.His brother, Mohammed Sameer, had said that he survived only because a visa delay kept him from travelling with the rest of the family. The sole survivor of a Saudi bus accident, Mohammed Abdul Shoaib, recounted how a tanker struck their vehicle, causing it to erupt in flames and kill 45 passengers, including his family. He escaped through a window as the bus caught fire, but his clothes ignited. Shoaib, now without support, has appealed to the Telangana government for a job. (Picture credit: PTI) NEW DELHI: The only survivor of the November 17 Umrah bus accident in Saudi Arabia returned to India on Tuesday and described the moments before the vehicle went up in flames, killing 45 other passengers. Mohammed Abdul Shoaib said the bus was travelling towards Madinah when a passenger asked the driver to stop for a toilet break. “As the driver stopped the bus, it was struck from behind by a tanker,” he said, as per ANI.Shoaib recalled that the driver escaped through a window immediately after the crash and “didn’t try to help any of the passengers”. As the fire spread rapidly, Shoaib managed to climb out of the same window, but his clothes had already caught fire. “There were 46 passengers on the bus, including me. Everyone else died,” he said, adding that his father, mother and maternal grandfather were among the victims.“I have no support left now. That is why I request the Telangana government to give me a government job,” he appealed.The group was part of a 54-member team that had flown from Hyderabad on November 9. Eighteen members of one extended family were among the dead. Shoaib survived only because he was seated beside the driver when the bus collided with the fuel tanker and burst into flames around 1.30 am.His brother, Mohammed Sameer, had said that he survived only because a visa delay kept him from travelling with the rest of the family.
