Supreme Court of India NEW DELHI: Noting that both partners in a marriage must work to meet individual as well as family needs and aspirations, which include securing good education for their wards, SC has said a child custody dispute between working parents cannot be decided in favour of one of them on the criterion that they work from home. A bench of Justices Manoj Misra and Ujjal Bhuyan remarked that it could not be said that the interests of the child would be better served by the parent who worked from home, than the other who went to office daily.“It is not in dispute that both parents are working parents and, therefore, it is expected that they cannot always be physically with their children. But this cannot be a ground to place the custody of the child with the one who may be temporarily working from home because it is a matter of common knowledge that to meet individual as well as family aspirations, married couples have to work to build a proper home, and most importantly, to secure better education for their ward… We, therefore, do not subscribe to the view that if one parent is working from home and the other is not (i.e., has to visit his office for work) then it has to be inferred that child’s interest would be better served if he is placed in the custody of one who does not go to office for work,” the bench said.SC was hearing a custody dispute over a five-year-old boy in NCR. The couple has two children — a boy and a girl, with the former living with the father and the girl with the mother. SC interacted with the minor who wanted the company of his sister but was not willing to leave his father.“What is important is that from our interactions we noticed he was not willing to part company of his father. We also took notice of the fact that his father has a few elder members at home, including grandfather, who are giving company to the child. In such circumstances, having regard to thefact that the male child is now above five years old and hecontinues to be in the same school where he was studying earlier, and he has no issues with his own father and is not willing to part company of his father, an interference with the order passed by HC is not required, particularly in view of the fact that the appellant (mother) has visitation rights as directed earlier by this court ,” the court said.HC, while granting custody of the child to the father, had mentioned he was working from home. Social welfare dept is probing her confinement ‘as case of potential criminal negligence, unlawful detention’, Bastar collector said RAIPUR: A bizarre case of a foster family allegedly trying to “protect” a young woman from a suspected molester by locking her in a room since she was eight has come to light in Chhattisgarh’s Bastar after officials reached their home to rescue her from what had been her prison for two decades.The orphaned girl, now in her 20s, barely responds when her name is called, has severely impaired eyesight, and appears traumatised after years without exposure to sunlight, open air or social contact, said Sister Clarelit of Gharaunda Ashram at Korchuli near Jagdalpur.Bastar collector Harish S told TOI the social welfare dept is probing her forced confinement “as a case of potential criminal negligence, unlawful detention, and violation of human rights”.“Officials are questioning her family members and probing the circumstances that led to such prolonged confinement… We will initiate action once the report is filed,” he said.Sources in the department quoted the woman’s foster family as saying they feared she would be sexually assaulted by an unidentified young man in the neighbourhood who had allegedly been after her. J&K CM Omar Abdullah (PTI) SRINAGAR: Sheikh Mohammad Abdullah “resides in the hearts of people” whether his Dec 5 birth anniversary is declared a holiday or not, his grandson and J&K CM Omar Abdullah said Thursday, five years after the date tied to the National Conference (NC) founder was taken off the list of public holidays by the Centre-appointed lieutenant governor.“Declaring a holiday on such occasions is not within the powers of the elected govt. The decision lies with the Centre. That is why we keep saying we should have our statehood back so that we can take both big and small decisions. Holiday or not, (it) will not be the yardstick to gauge his contribution,” Omar said.The CM was responding to questions about the anniversary, which NC plans to observe on a grand scale on Friday. He was speaking on the sidelines of a passing-out parade of 711 Agniveers of Jammu and Kashmir Light Infantry (JAKLI) Regiment in Srinagar.In Jan 2020, five months after the abrogation of Article 370, the LG’s administration removed Sheikh Abdullah’s birth anniversary from the list of holidays along with Martyrs’ Day, observed on July 13 to commemorate the killings of protesters by Dogra forces in 1931. By contrast, in 2022 the birth anniversary of last Dogra ruler Maharaja Hari Singh on Sept 23 was added to the list of holidays.Earlier, Omar turned his address in freezing cold at the passing-out parade of Agniveers into a brief history lesson, saying this was the first time he had the opportunity to attend such an event at JAKLI regiment.“You are joining a regiment that has deep ties with Jammu and Kashmir. A proposal seeking more funds will be placed before the chief minister during the next budget meeting.Boseraju was speaking at the Jawaharlal Nehru Planetarium, where he inaugurated a training programme for KRIES teachers on operating and maintaining the telescopes supplied to their schools. The effort is part of a broader push to strengthen astronomy-based learning across the State.Under the scheme, 833 residential schools and PU colleges under KRIES have each received a telescope at a total cost of Rs 3 crore. Boseraju said no other government department in the country had taken up a project of this scale. He added that the department hopes to extend telescope distribution to more schools in the coming year. Security agencies launched an extensive search operation in Ajmer, Rajasthan, following a bomb threat email claiming RDX-based explosives were planted at the Ajmer Sharif dargah, district collectorate, and Kudankulam Nuclear Power Plant. The email warned of detonation coinciding with Russian President Vladimir Putin’s arrival. Premises were evacuated and thoroughly checked, with no suspicious objects found so far. The email claimed that RDX-based explosives had been planted at the Ajmer Sharif dargah, the district collectorate and the Kudankulam Nuclear Power Plant in Tamil Nadu. It also warned that the bombs would be triggered in connection with the arrival of Russian President Vladimir Putin, police said. Drones, Snipers And Armoured Convoy: India Rolls Out Unmatched Security Grid For Putin’s Delhi Visit According to officials, the threatening email was received at the Ajmer collectorate around noon. It claimed that four RDX-based improvised explosive devices (IEDs) had been planted at the dargah of Khwaja Moinuddin Chishti, the collectorate premises and the Kudankulam atomic plant. The letter also warned that the bombs would detonate upon the arrival of President Putin, news agency PTI reported. Superintendent of Police Vandita Rana said all departments were immediately alerted after the threat mail surfaced. “An email threatening to bomb the Ajmer dargah and the collectorate was received. Following this, the premises were evacuated and checked thoroughly,” she said.She added that the dargah complex was also cleared and a detailed search operation is underway. “So far, no suspicious object has been found,” Rana said.Teams of the Crime Investigation Department (CID), Anti-Terrorism Squad (ATS), dog squads and bomb disposal units have been deployed at the affected locations. Security personnel from four police stations, along with additional forces, are conducting systematic checks using metal detectors as part of the operation.Entry into the Ajmer Sharif dargah has been temporarily halted, leading to large crowds gathering outside the main gates. The entire area around the shrine has been cordoned off and all incoming visitors have been stopped until the search is completed.Senior officials, including three civic body commissioners and station house officers from nine police stations, have been stationed at the site to supervise the operation. MP D. Chandrashekhar Azad (File photo) NEW DELHI: Defending Samajwadi Party (SP) MP Mohibbullah Nadvi, who used the word “jihad” in Parliament, Aazad Samaj Party (ASP) chief Chandrashekhar Azad on Thursday said the term means the same as “jaddojahad” (struggle/great effort) in Hindi.“Jihad is simply an Arabic term for what we describe in Hindi as ‘jaddojahad’ — the fight against oppression,” he told PTI Videos. “Oppression Will Trigger Jihad”: Jamiat Chief’s Explosive Claim Stirs Storm “I’ve always maintained that anyone facing oppression or having their rights taken away will stand up against injustice,” Azad added. “Our country won freedom through a long and difficult struggle, with thousands making the ultimate sacrifice — that, too, is ‘sangharsh’ (struggle).”The Nagina MP also questioned the need to reinterpret the term “jihad” to suit “one’s own convenience.”Azad further said, “He (Nadvi) was simply talking about jihad against oppression. As an Islamic scholar, he was only trying to tell his people to stand up against injustice. People have six months to upload their properties on the UMEED portal, but even the server is down and there are constant issues. Around 70% of properties have not been registered. Today, it seems Articles 25 and 26 — the right to practise and manage one’s own religious affairs — are being destroyed in the country, and Muslims’ lives have become troubled.”Claiming that several people were drawing parallels with the freedom struggle, he continued, “Many are saying that, just as we had to fight during the independence movement, we may again have to protest against injustice — we may have to do jihad. How long will Muslims continue to be oppressed in this country?”His remarks prompted sharp criticism from the ruling BJP MPs.On Thursday, Nadvi defended his comments and declared a “boycott” of the media, accusing news outlets of “mocking” the Muslim community.“I said what I had to say, and in the context I had to, in Parliament.
