Prabir Purkayastha (File photo) NEW DELHI: The Enforcement Directorate (ED) has imposed a penalty of Rs 184 crore under the Foreign Exchange Management Act (FEMA) on news portal NewsClick and its editor-in-chief, Prabir Purkayastha, official sources told news agency ANI on Monday.The order levies a penalty of Rs 120 crore on PPK NewsClick Studio Private Limited, the company that owns the portal, while Purkayastha has been fined Rs 64 crore for alleged violations.The entities have been found “contravening” the provisions of FEMA on two primary counts. First involved misrepresentation of foreign direct investment (FDI) funds, and second, misdeclaration of services and exports.NewsClick’s response to the order is awaited.The ED had earlier conducted searches at the portal’s premises in the Saidulajab area of Delhi in September 2021 in connection with a money laundering probe. During the course of the investigation, the agency recorded statements from more than 25 individuals, including Purkayastha.In 2023, the ruling Bharatiya Janata Party (BJP) cited a New York Times report to allege irregularities involving the portal and its promoters. The article had claimed that NewsClick was part of a global network that received funding from American billionaire Neville Roy Singham, who allegedly works closely with the Chinese government media apparatus.The same year, Delhi Police’s Special Cell conducted raids at 30 premises connected with online portal NewsClick as well as its journalists’ houses. Teams of the Delhi Police special cell and Mumbai Police also carried out searches at activist Teesta Setalvad’s residence in Juhu.The Police officials also brought NewsClick editor Prabir Purkayastha, writers Paranjoy Guha Thakurta, and Urmilesh to the special cell offices in the national capital.Founded in 2009, NewsClick describes itself on its website as an independent media organisation focused on reporting news from India and around the world, with particular emphasis on progressive movements. The NCLT’s Mumbai Bench admitted the insolvency plea in August 2024 over a claimed default of Rs 87.43 crore, and the NCLAT later upheld the order. NEW DELHI: The Supreme Court on Thursday underscored the need to regulate the use of artificial intelligence in judicial proceedings, noting that unverified AI-generated material could undermine the administration of justice.Directing the Bar Council of India (BCI) to set up a committee to examine the use of AI in legal practice and adjudication, the court said there was a clear need for regulatory safeguards. It also urged both the Bar and the Bench to exercise caution while using such technology.The court observed that while AI can assist in adjudication, it should not replace human reasoning or decision-making. It emphasised that human oversight must remain central at every stage of the judicial process.Raising concerns about the use of fabricated or non-existent AI-generated legal precedents, the court warned that such material could adversely affect the integrity of the justice system. Describing the use of fake, non-existent and AI-generated hallucinated legal precedents as “invisible, insidious and catastrophic” to justice, the court likened it to “the release of methyl isocyanate (a highly toxic, flammable, and volatile organic compound) in the field of law and justice”.The observations came while the apex court set aside the National Company Law Tribunal (NCLT) and National Company Law Appellate Tribunal (NCLAT) orders in the Essel Infraprojects insolvency case after finding that the NCLT had relied on non-existent, fake and AI-generated hallucinated judicial precedents while deciding the matter. The court held that such reliance strikes at the integrity of the adjudicatory process and warranted fresh consideration of the dispute.Why the Supreme Court set aside the Essel Infraprojects ordersA bench of justices PS Narasimha and Alok Aradhe was hearing an appeal filed by suspended director Pooja Ramesh Singh against the NCLT’s decision admitting Essel Infraprojects into the corporate insolvency resolution process on a petition filed by Jammu and Kashmir Bank under Section 7 of the Insolvency and Bankruptcy Code.The insolvency proceedings arose from an alleged default linked to a Rs 200 crore credit facility extended by Jammu and Kashmir Bank to Pan India Utilities Distribution Company Limited. The loan was backed by a corporate guarantee from Essel Infraprojects and a mortgage over land in Gorai, Borivali, Mumbai.The NCLT’s Mumbai Bench admitted the insolvency plea in August 2024 over a claimed default of Rs 87.43 crore, and the NCLAT later upheld the order.However, the Supreme Court found that the NCLT had relied on fabricated and non-existent AI-generated judgments as legal precedents while reaching its conclusion.Holding that such reliance cannot be tolerated, the Bench said, “It is necessary for Courts to adopt a zero-tolerance mode for producing, citing or using AI-generated precedents without verification. It is a misconduct on the part of an advocate to cite such judgments without verification.”The court further said it was an equally serious lapse if judges relied on fake or hallucinated AI-generated material while deciding cases.”We have no hesitation in declaring that such a decision is no decision in the eyes of the law, irrespective of whether such material had a direct or indirect bearing on the decision-making. Such decisions are to be set aside even if an iota of fake or hallucinated material enters the decision-making process, as it would violate the sanctity of adjudication,” the Bench observed.Accordingly, the Supreme Court set aside both the NCLT and NCLAT orders and directed the tribunal to decide the matter afresh on the facts of the case.Clarifying the scope of its ruling, the court said it was not examining the technical reasons behind AI hallucinations or ways to eliminate them. Those issues, it said, were for engineers and scientists. The NCLT’s Mumbai Bench admitted the insolvency plea in August 2024 over a claimed default of Rs 87.43 crore, and the NCLAT later upheld the order. NEW DELHI: The Supreme Court on Thursday underscored the need to regulate the use of artificial intelligence in judicial proceedings, noting that unverified AI-generated material could undermine the administration of justice.Directing the Bar Council of India (BCI) to set up a committee to examine the use of AI in legal practice and adjudication, the court said there was a clear need for regulatory safeguards. It also urged both the Bar and the Bench to exercise caution while using such technology.The court observed that while AI can assist in adjudication, it should not replace human reasoning or decision-making. It emphasised that human oversight must remain central at every stage of the judicial process.Raising concerns about the use of fabricated or non-existent AI-generated legal precedents, the court warned that such material could adversely affect the integrity of the justice system. Describing the use of fake, non-existent and AI-generated hallucinated legal precedents as “invisible, insidious and catastrophic” to justice, the court likened it to “the release of methyl isocyanate (a highly toxic, flammable, and volatile organic compound) in the field of law and justice”.The observations came while the apex court set aside the National Company Law Tribunal (NCLT) and National Company Law Appellate Tribunal (NCLAT) orders in the Essel Infraprojects insolvency case after finding that the NCLT had relied on non-existent, fake and AI-generated hallucinated judicial precedents while deciding the matter. The court held that such reliance strikes at the integrity of the adjudicatory process and warranted fresh consideration of the dispute.Why the Supreme Court set aside the Essel Infraprojects ordersA bench of justices PS Narasimha and Alok Aradhe was hearing an appeal filed by suspended director Pooja Ramesh Singh against the NCLT’s decision admitting Essel Infraprojects into the corporate insolvency resolution process on a petition filed by Jammu and Kashmir Bank under Section 7 of the Insolvency and Bankruptcy Code.The insolvency proceedings arose from an alleged default linked to a Rs 200 crore credit facility extended by Jammu and Kashmir Bank to Pan India Utilities Distribution Company Limited. The loan was backed by a corporate guarantee from Essel Infraprojects and a mortgage over land in Gorai, Borivali, Mumbai.The NCLT’s Mumbai Bench admitted the insolvency plea in August 2024 over a claimed default of Rs 87.43 crore, and the NCLAT later upheld the order.However, the Supreme Court found that the NCLT had relied on fabricated and non-existent AI-generated judgments as legal precedents while reaching its conclusion.Holding that such reliance cannot be tolerated, the Bench said, “It is necessary for Courts to adopt a zero-tolerance mode for producing, citing or using AI-generated precedents without verification. It is a misconduct on the part of an advocate to cite such judgments without verification.”The court further said it was an equally serious lapse if judges relied on fake or hallucinated AI-generated material while deciding cases.”We have no hesitation in declaring that such a decision is no decision in the eyes of the law, irrespective of whether such material had a direct or indirect bearing on the decision-making. Such decisions are to be set aside even if an iota of fake or hallucinated material enters the decision-making process, as it would violate the sanctity of adjudication,” the Bench observed.Accordingly, the Supreme Court set aside both the NCLT and NCLAT orders and directed the tribunal to decide the matter afresh on the facts of the case.Clarifying the scope of its ruling, the court said it was not examining the technical reasons behind AI hallucinations or ways to eliminate them. Those issues, it said, were for engineers and scientists. NEW DELHI: NEET UG results will be declared by July 20, a senior official at the National Testing Agency told news agency ANI on Thursday.While the official did not provide an exact detail but confirmed that the agency is working on a war footing to release the results soon. He, however, assured that the academic year for MBBS students will not be delayed.”We would not like to give out any date as of now, but the result will be out by July 20,” a senior NTA official told ANI during a telephonic interview. As per the official, around 10,000 challenges were received from aspirants.Re-NEET was conducted on June 21 after the May 3 examination was cancelled after paper leak.A fee of Rs 200 is charged per question and is refunded if the student’s challenge is found to be correct.The official also assured that, despite NEET being conducted again, the academic year will not be delayed, even though there is no clarity yet on the counselling process, which usually takes over one month.After the NEET-UG result is declared, the Medical Counselling Committee (MCC) releases the counselling schedule for the 15 per cent All India Quota (AIQ), AIIMS, JIPMER, central and deemed universities, while individual states announce separate schedules for their 85 per cent state quota seats.In a normal NEET year, the first-year MBBS academic session usually starts in August or September, depending on how quickly counselling concludes. The official said that this year, too, the session will begin on time.Candidates register online, pay the required counselling fee, and fill in and lock their preferred choices of colleges and courses, following which seats are allotted based on NEET rank, category, reservation norms, preferences, and seat availability.Get the latest India news and live updates.
