Representative image BENGALURU: A local court in Chitradurga on Wednesday acquitted Murugha Mutt seer Shivamurthy Murugha Sharanaru and two others in a Pocso case registered in Aug 2022. The seer, however, faces another Pocso case filed on Oct 13, 2022, in which Karnataka HC has stayed the investigation.Two girls from a hostel run by the mutt had alleged in Aug 2022 that the seer had raped them. Five persons – including a minor boy – were named as accused. The seer was arrested on Sept 1.The court also acquitted hostel warden Rashmi and hostel manager Parame Shivaiah. Reading his one-line order, district and sessions judge Gangadharappa Channabasappa Hadapad announced, “All acquitted.”In Davanagere, the seer declined to comment. The seer’s counsel said: “We have to see the order copy to get more clarity on the grounds of acquittal and other details. We will address the media in a day or two,” he said. NEW DELHI: For the first time, Supreme Court on Wednesday assembled a global bench as chief justices and the most senior judges of six countries joined CJI Surya Kant and Justice Joymalya Bagchi to watch first-hand how the highest court in India conducts its proceedings.Chief justices and judges from foreign countries sitting as guests on the dais in the CJI’s courtroom is an old tradition. But never had the chief justices of so many countries partnered – even though they did not participate in adjudication – the CJI-led bench.On the bench were Chief Justice of Bhutan Lyonpo Norbu Tshering, who did his LLB from Delhi University’s Campus Law Centre, Chief Justice and President of Kenyan Supreme Court Martha Koome, Mauritius Chief Justice Bibi Rehana Mungly-Gulbul, Sri Lankan Chief Justice P Padman Surasena, most senior judge of Malaysian Federal Court Justice Tan Sri Datuk Nallini Pathmanathan and most senior judge of Nepal Supreme Court Justice Sapana Pradhan Malla.After proceedings that included adjudication of bail to an academician accused of sexual harassment and the Andhra Pradesh liquor case, CJI Kant said it was a historic moment for Supreme Court of India to witness assembling of so many legal luminaries. Solicitor general Tushar Mehta welcomed them on behalf of govt and senior advocates Kapil Sibal and Rakesh Dwivedi extended courtesies on behalf of advocates.CJ Koome said the Kenyan SC looked up to the constitutional interpretations of the Indian SC. CJ Tshering said the basic structure doctrine evolved by the SC of India continued to be a guiding principle. “I have never seen so many advocates in a courtroom,” he added.CJ Surasena said while Supreme Court at Madras was established in 1800, the Sri lankan SC was set up in 1801, and since then, the two countries have followed the same legal system. NEW DELHI: For the first time, Supreme Court on Wednesday assembled a global bench as chief justices and the most senior judges of six countries joined CJI Surya Kant and Justice Joymalya Bagchi to watch first-hand how the highest court in India conducts its proceedings.Chief justices and judges from foreign countries sitting as guests on the dais in the CJI’s courtroom is an old tradition. But never had the chief justices of so many countries partnered – even though they did not participate in adjudication – the CJI-led bench.On the bench were Chief Justice of Bhutan Lyonpo Norbu Tshering, who did his LLB from Delhi University’s Campus Law Centre, Chief Justice and President of Kenyan Supreme Court Martha Koome, Mauritius Chief Justice Bibi Rehana Mungly-Gulbul, Sri Lankan Chief Justice P Padman Surasena, most senior judge of Malaysian Federal Court Justice Tan Sri Datuk Nallini Pathmanathan and most senior judge of Nepal Supreme Court Justice Sapana Pradhan Malla.After proceedings that included adjudication of bail to an academician accused of sexual harassment and the Andhra Pradesh liquor case, CJI Kant said it was a historic moment for Supreme Court of India to witness assembling of so many legal luminaries. Solicitor general Tushar Mehta welcomed them on behalf of govt and senior advocates Kapil Sibal and Rakesh Dwivedi extended courtesies on behalf of advocates.CJ Koome said the Kenyan SC looked up to the constitutional interpretations of the Indian SC. CJ Tshering said the basic structure doctrine evolved by the SC of India continued to be a guiding principle. “I have never seen so many advocates in a courtroom,” he added.CJ Surasena said while Supreme Court at Madras was established in 1800, the Sri lankan SC was set up in 1801, and since then, the two countries have followed the same legal system. Representative image NEW DELHI: National Medical Commission (NMC) has turned down a proposal from Shri Mata Vaishno Devi Institute of Medical Excellence (SMVDIME), Katra, seeking to place 100% of its 50 MBBS seats under the All-India Quota (AIQ) through the Medical Counselling Committee (MCC).An NMC official said the commission did not approve the request as it would go against policy. Such decisions require broader consultation with states and stakeholders, and existing regulations cannot be amended for a single institution. Under current rules, 85% of MBBS seats are reserved for the state quota and 15% for the All-India Quota. “This is not just about SMVDIME. Any change will have to be worked out with all states and stakeholders on board,” the official said.The proposal may be placed before the board for further deliberation if needed, but the commission has declined it for now.The SMVDIME proposal comes at a time when the institution has found itself at the centre of controversy. Several Hindu organisations, including Sanatan Dharam Sabha and Vishwa Hindu Parishad, have protested over 43 out of the first batch of 50 MBBS students reportedly being from a particular community. NEW DELHI: The Unique Identification Authority of India (UIDAI) has deactivated over two crore Aadhaar numbers belonging to deceased individuals as part of a nationwide clean-up drive to strengthen the accuracy and reliability of the Aadhaar database.Officials said the exercise is aimed at preventing identity fraud and ensuring that govt benefits linked to Aadhaar are accessed only by eligible beneficiaries. According to UIDAI, the deactivation process draws on data sourced from the Registrar General of India (RGI), state and Union Territory administrations, the public distribution system, the National Social Assistance Programme and other departments that maintain death-registration records. Why Ask Voters For Enumeration Forms: Sibal NEW DELHI: Supreme Court on Wednesday emphatically said the Election Commission is statutorily and constitutionally empowered to conduct the pan-India Special Intensive Revision (SIR) of electoral rolls and that it would not stall the process, while assuring that it would order corrective measures, if any irregularities were brought to its notice.CJI Surya Kant and Justice Joymalya Bagchi rejected arguments questioning the justification of SIR, with the former saying not a single objection was filed against the updation of electoral rolls after the process was fine-tuned at the apex court’s instance.Appearing for RJD MP Manoj Jha, senior advocate Kapil Sibal commenced arguments questioning SIR’s constitutional validity, saying there are millions of illiterate people who can’t fill voter enumeration forms, which have become a tool for exclusion.”Why should a voter be asked to fill an enumeration form at all? Who is EC to determine whether a person is an Indian citizen or not? Aadhaar card mentions the place of residence and date of birth, which should be enough for persons above 18 years to get enrolled as voters if they give a self-declaration that they are Indian citizens,” Sibal argued.CJI Kant said, “Sibal, you have experience of contesting elections in Delhi, where many people do not vote. But in rural areas, elections are a festival. There, everyone is concerned about their votes. A maximum number of people participate, and everyone knows who a resident of the village is.”CJI cites Bihar, says no impact on groundSenior advocate Kapil Sibal said such an exercise had never been conducted in India because the ethos of our ‘Poorna Swaraj’ mantra from the freedom struggle days was inclusionary, not exclusionary. Justice Bagchi said, “It is a matter of record that in 2012 and 2014, the number of voters exceeded the total adult population. Is it not necessary to correct the electoral roll? If EC has a doubt about someone’s citizenship, is it not entitled to inquire about it? If EC carries out an aggressive revision of the electoral roll, there will be deletions.”CJI Kant said the SIR of Bihar’s electoral rolls was a prime example. “Initially, the court was told that crores of voters are being deleted. We issued certain directions to streamline the process. Eventually, what happened? Among the deletions from the voter list were those found to have died or migrated outside. No one filed an objection. Why Ask Voters For Enumeration Forms: Sibal NEW DELHI: Supreme Court on Wednesday emphatically said the Election Commission is statutorily and constitutionally empowered to conduct the pan-India Special Intensive Revision (SIR) of electoral rolls and that it would not stall the process, while assuring that it would order corrective measures, if any irregularities were brought to its notice.CJI Surya Kant and Justice Joymalya Bagchi rejected arguments questioning the justification of SIR, with the former saying not a single objection was filed against the updation of electoral rolls after the process was fine-tuned at the apex court’s instance.Appearing for RJD MP Manoj Jha, senior advocate Kapil Sibal commenced arguments questioning SIR’s constitutional validity, saying there are millions of illiterate people who can’t fill voter enumeration forms, which have become a tool for exclusion.”Why should a voter be asked to fill an enumeration form at all? Who is EC to determine whether a person is an Indian citizen or not? Aadhaar card mentions the place of residence and date of birth, which should be enough for persons above 18 years to get enrolled as voters if they give a self-declaration that they are Indian citizens,” Sibal argued.CJI Kant said, “Sibal, you have experience of contesting elections in Delhi, where many people do not vote. But in rural areas, elections are a festival. There, everyone is concerned about their votes. A maximum number of people participate, and everyone knows who a resident of the village is.”CJI cites Bihar, says no impact on groundSenior advocate Kapil Sibal said such an exercise had never been conducted in India because the ethos of our ‘Poorna Swaraj’ mantra from the freedom struggle days was inclusionary, not exclusionary. Justice Bagchi said, “It is a matter of record that in 2012 and 2014, the number of voters exceeded the total adult population. Is it not necessary to correct the electoral roll? If EC has a doubt about someone’s citizenship, is it not entitled to inquire about it? If EC carries out an aggressive revision of the electoral roll, there will be deletions.”CJI Kant said the SIR of Bihar’s electoral rolls was a prime example. “Initially, the court was told that crores of voters are being deleted. We issued certain directions to streamline the process. Eventually, what happened? Among the deletions from the voter list were those found to have died or migrated outside. No one filed an objection. NEW DELHI: PM Narendra Modi marked Constitution Day on Wednesday by urging citizens to never miss out on their constitutional right to vote and renewed his pitch for balancing rights with duties.PM Modi has often emphasised that while the issue of people’s rights has received attention, the Constitution’s similar focus on their duties was overlooked. He cited a host of stalwarts, including Mahatma Gandhi, to underscore the primacy of duties for social and economic progress.As the country moves forward to realising the dream of a developed India, people must always place their duties towards the nation foremost in their minds, he said.In a letter to citizens on Constitution Day, which was announced by his government in 2015, PM Modi suggested that people organise special events on November 26 to mark the coming-of-age of youngsters in schools and colleges to celebrate first-time voters. Constitution gives us rights, reminds us of our duties: PMFirst-time voters will make them feel that they are also active participants in the process of nation-building, PM Modi said. “It is our duty to never miss the opportunity to vote in national, state and local elections where we are registered,” the PM said. Gavai Clarifies He Never Faced Political Or Executive Pressure During His TenureReiterating the constitutional separation of powers, Gavai said the judiciary functions independently and the allegation that Collegium appointments lack transparency is “not well-founded.” He also dismissed the idea of prescribing a fixed tenure for CJIs or Supreme Court judges, noting that shorter terms do not affect judicial performance.On the role and limits of judicial intervention, Gavai cautioned against overreach. “There are limits within which judicial activism should act. As I always say, judicial activism should not turn into judicial terrorism,” he said.He emphasised that courts must step in when vulnerable citizens cannot approach the system due to socio-economic barriers, but even then, constitutional boundaries must be respected.Discussing the Supreme Court’s ruling against “bulldozer justice”, where state authorities demolished homes of individuals accused of crimes, the former CJI said the Court acted after noticing that properties were being razed without notice or legal sanction. He described such instances as clear executive overreach.”When merely because a citizen was involved in a criminal act, his house was demolished… it was like taking the law into one’s own hands,” he said, adding that families of the accused suffer unjustly. “What is the crime committed by his family? Why bulldoze their roof?” he asked, questioning the constitutional basis of collective punishment.Gavai noted that the Court allowed citizens to directly approach High Courts in demolition cases and laid down strict norms to fix accountability. Illegal demolitions, he said, could require the government to rebuild structures and recover costs from officials responsible.Reflecting on his tenure of six months and 10 days, he said, “It included summer vacation, Dussehra vacation and Diwali vacation. But I could perform whatever I had anticipated and planned out. He described such instances as clear executive overreach.”When merely because a citizen was involved in a criminal act, his house was demolished… it was like taking the law into one’s own hands,” he said, adding that families of the accused suffer unjustly. “What is the crime committed by his family? Why bulldoze their roof?” he asked, questioning the constitutional basis of collective punishment.Gavai noted that the Court allowed citizens to directly approach High Courts in demolition cases and laid down strict norms to fix accountability. Illegal demolitions, he said, could require the government to rebuild structures and recover costs from officials responsible.Reflecting on his tenure of six months and 10 days, he said, “It included summer vacation, Dussehra vacation and Diwali vacation. But I could perform whatever I had anticipated and planned out. But we continue to lag in giving women adequate representation in judiciary, legislature and executive,” Murmu said at the Constitution Day celebrations organised by Supreme Court, which has only one woman among 33 judges.Speaking in the presence of CJI Surya Kant and law minister Arjun Ram Meghwal, the President said taking steps to give adequate representation to women in all three wings of governance will require a change of mindset. It was SCBA president Vikas Singh who mentioned extremely low representation of women in judiciary – 13% in HCs and 35% in trial courts.She said annual commemoration of the Constitution’s adoption on Nov 26, 1949, is often marked by speeches made by dignitaries. “Have we ever looked back and assessed in the last 75 years how much we have progressed in achieving the constitutional goals of justice, equality, liberty and fraternity for every citizen? That is the question, not only for the judiciary, legislature or executive, but for everyone.”Addressing another Constitution Day event in Central Hall of old Parliament building or Samvidhan Sadan, Murmu described the Constitution as the bedrock of “our national pride and national identity”, and as a guiding text for taking India forward with a “nationalist mindset by abandoning the colonial mindset”.In front of an audience that included Vice-President C P Radhakrishnan, PM Narendra Modi, Lok Sabha Speaker Om Birla, opposition leaders of Rajya Sabha and Lok Sabha, Mallikarjun Kharge and Rahul Gandhi, respectively, and members of both Houses of Parliament, Murmu cited implementation of legislations related to the criminal justice system as an example of the effort to shun the colonial mindset. But Delhi Yet To Take Call On Buying 5th-Gen Sukhoi-57 Jets NEW DELHI: India’s plan to acquire another five squadrons of the S-400 Triumf air defence systems as well as a large number of its surface-to-air missiles for already inducted systems, which performed exceedingly well during Operation Sindoor, are likely to figure in discussions during the Modi-Putin summit here on Dec 5.However, India is yet to take a call on acquiring two-three squadrons of the Russian fifth-generation Sukhoi-57 fighter, which Moscow is aggressively hawking vis-a-vis the American F-35 Lightning-II jets, top sources told TOI on Tuesday.”There is a case for IAF to induct two-three squadrons of fifth-generation fighters as a stopgap measure till the indigenous stealth AMCA (advanced medium combat aircraft) becomes ready for induction by 2035 or so. But no decision has been made on the Sukhoi-57, F-35 or any other choice,” a source said.Meanwhile, the PM-led cabinet committee on security (CCS) is set to approve the Rs 63,000 crore upgrade of the first lot of 84 Sukhoi-30MKI fighters – IAF has 259 such Russian-origin jets – with advanced radars, avionics, longer-range weapons and multi-sensor fusion to ensure they are capable of air combat for another 30 years. “While the upgrade will be carried out indigenously, Russia will have some role in it,” another source said.India has been trying to strike a balance between its long-standing arms supplier Russia and the increasingly transactional US under the Trump administration that wants to punish countries for buying Russian oil and arms.Several defence deals are in the pipeline with the US, which has already bagged Indian contracts worth billion over the last 15 years. But Delhi Yet To Take Call On Buying 5th-Gen Sukhoi-57 Jets NEW DELHI: India’s plan to acquire another five squadrons of the S-400 Triumf air defence systems as well as a large number of its surface-to-air missiles for already inducted systems, which performed exceedingly well during Operation Sindoor, are likely to figure in discussions during the Modi-Putin summit here on Dec 5.However, India is yet to take a call on acquiring two-three squadrons of the Russian fifth-generation Sukhoi-57 fighter, which Moscow is aggressively hawking vis-a-vis the American F-35 Lightning-II jets, top sources told TOI on Tuesday.”There is a case for IAF to induct two-three squadrons of fifth-generation fighters as a stopgap measure till the indigenous stealth AMCA (advanced medium combat aircraft) becomes ready for induction by 2035 or so. But no decision has been made on the Sukhoi-57, F-35 or any other choice,” a source said.Meanwhile, the PM-led cabinet committee on security (CCS) is set to approve the Rs 63,000 crore upgrade of the first lot of 84 Sukhoi-30MKI fighters – IAF has 259 such Russian-origin jets – with advanced radars, avionics, longer-range weapons and multi-sensor fusion to ensure they are capable of air combat for another 30 years. “While the upgrade will be carried out indigenously, Russia will have some role in it,” another source said.India has been trying to strike a balance between its long-standing arms supplier Russia and the increasingly transactional US under the Trump administration that wants to punish countries for buying Russian oil and arms.Several defence deals are in the pipeline with the US, which has already bagged Indian contracts worth $26 billion over the last 15 years. However, while Omar expressed concern that religious educational institutions were being unfairly targeted, Sinha asserted that the “practice of rewarding separatism” had stopped after provisions of the Constitution were made fully applicable to J&K in 2019.Addressing students and faculty at the 50th annual celebration of Jamia Zia-ul-Uloom, a madrassa in Jammu’s Poonch district, Omar said “propaganda and lies” were being spread against Muslim religious institutions in many parts of the country. This was unpatriotic, he added.As the programme began with the national anthem, patriotic songs and Constitutional Day pledges, the CM said, “I wish those people who spread venom against religious educational institutions through social media and the press had been here today to witness this programme. They claim that the institutions like Zia-ul-Uloom teach nothing except communalism, and only impart religious education. But you can see that along with religious studies, they teach science, mathematics and all other subjects.”On social media, “lies are spread that these institutions promote anti-national sentiment”, where one could see here that the reality was completely different, he said.Omar said symbolic observation of Constitution Day meant nothing if its ideals were not followed. “Today, we observed Constitution Day. The row erupted after only eight Hindu students from Jammu made it to the first MBBS batch of 50. The admissions were based on the NEET merit list.Omar said Zia-ul-Uloom has always supported the govt and had always helped during natural disasters. NEW DELHI: Chief election commissioner (CEC) Gyanesh Kumar will on December 3 take up chairship of the International Institute for Democracy and Electoral Assistance (IIDEA) for the year 2026 in Stockholm, reflecting a “global recognition of the Election Commission’s standing as one of the world’s most credible and innovative election management bodies (EMBs),” as per EC.IIDEA is an intergovernmental organisation created in February 1995, with India as a founding member, to support sustainable democracy worldwide. It has, over the past three decades, evolved into a key global convenor for EMBs, constitutional experts, political institutions and democratic practitioners from across continents. It currently comprises 35 member countries including Australia, France, Germany, Indonesia, Mauritius, South Africa, Chile and Sweden, with the US and Japan acting as observer states. Electoral processes and electoral research are among its focus areas. IIDEA through its council of member states annually elects a chair and two vice-chairs. Its present chairship is held by Switzerland and will now pass on to India.EC To Launch SIR in 12 States and UTs in Phase 2, CEC Gyanesh Kumar Says Zero Complaints in BiharAs Chair, Kumar will be presiding over all council meetings through 2026. EC in a statement on Wednesday said the CEC “will leverage the country’s unmatched experience of conducting the world’s largest elections to shape IIDEA’s global agenda”. NEW DELHI: Chief election commissioner (CEC) Gyanesh Kumar will on December 3 take up chairship of the International Institute for Democracy and Electoral Assistance (IIDEA) for the year 2026 in Stockholm, reflecting a “global recognition of the Election Commission’s standing as one of the world’s most credible and innovative election management bodies (EMBs),” as per EC.IIDEA is an intergovernmental organisation created in February 1995, with India as a founding member, to support sustainable democracy worldwide. It has, over the past three decades, evolved into a key global convenor for EMBs, constitutional experts, political institutions and democratic practitioners from across continents. It currently comprises 35 member countries including Australia, France, Germany, Indonesia, Mauritius, South Africa, Chile and Sweden, with the US and Japan acting as observer states. Electoral processes and electoral research are among its focus areas. IIDEA through its council of member states annually elects a chair and two vice-chairs. Its present chairship is held by Switzerland and will now pass on to India.EC To Launch SIR in 12 States and UTs in Phase 2, CEC Gyanesh Kumar Says Zero Complaints in BiharAs Chair, Kumar will be presiding over all council meetings through 2026. EC in a statement on Wednesday said the CEC “will leverage the country’s unmatched experience of conducting the world’s largest elections to shape IIDEA’s global agenda”. Ironically, the international appreciation and IIDEA leadership for the CEC comes against the backdrop of constant attacks faced by him and EC from the opposition parties here, on the electoral roll health and the special intensive revision (SIR) exercise.“The collaboration (between EC and IIDEA) will strengthen knowledge-sharing, reinforce professional networks among EMBs, and support evidence-based global electoral reforms,” the poll panel underlined on Wednesday.It added that “Kumar will leverage the country’s unmatched experience of conducting the world’s largest elections to shape IIDEA’s global agenda”.According to EC, India, with the world’s largest electorate of 1 billion and well-documented, transparent electoral processes, will share its best practices with EMBs from across the world, in the coming year. KOLKATA: The Central Bureau of Investigation’s Anti-Corruption Branch (ACB) in Kolkata has arrested Abul Hossen Molla, also known as Duronto, from South 24 Parganas district in West Bengal. He was taken into custody on Wednesday evening.According to officials, Molla was allegedly involved in the mob attack on Enforcement Directorate (ED) officials in the Sandeshkhali area in January 2024.He had been absconding for months and had consistently evaded multiple notices issued by the CBI to join the investigation.A competent court had also issued a Non-Bailable Warrant (NBW) against him after he failed to appear and remained underground.CBI officials confirmed that the accused is being produced before the court today. Further investigation into the Sandeshkhali attack case is underway.Meanwhile, Sandeshkhali, a village in West Bengal’s North 24 Parganas district, had been in a political storm after villagers, mostly women, came out on the streets against the ruling TMC and its strongman Shahjahan, accusing him and his aides of “land-grab and sexual assault” under coercion. He was later arrested. Both the BJP and Trinamool Congress have been levelling charges against each other over Sandeshkhali. Earlier, the Calcutta High Court directed a court-monitored investigation by the CBI into the alleged cases of sexual assault and land grabbing in Sandeshkhali. NEW DELHI: The operational cooperation between India and the US in the area of counter-narcotics has “surged” in the last several years, and New Delhi wants to further strengthen the joint fight against narcotics, the MEA said on Wednesday. At his weekly media briefing, external affairs ministry spokesperson Randhir Jaiswal, in response to a query, said joint operations have been conducted which have dismantled major trans-national networks. The MEA spokesperson said the fight against narcotics was a “very good” area of cooperation, which could see further strengthening in the future. The cooperation has been given a further push with the launch of the India-US Counternarcotics Working Group in 2020. And, the fifth meeting of the happened last year in October, where both sides adopted several measures to strengthen their fight against common challenges, Jaiswal said. The preparation for the sixth meeting is underway, he said.”We have a strong mechanism of sharing information between the US and India, and these have resulted in key seizures and arrests,” the MEA spokesperson added. India has a “very strong collaboration, and not just strong collaboration, institutional collaboration with the United States, and these are based on long-standing agreements that we have between the two countries,” he said. Punjab CM Bhagwant Mann CHANDIGARH: Punjab chief minister Bhagwant Mann on Wednesday stressed on strategic partnership with Japan across key sectors such as advanced manufacturing, mobility, electronics, food processing, renewable energy, and global services. Mann virtually held a detailed deliberation with a high-level delegation from Japan, comprising representatives of the Embassy of Japan and leading Japanese companies operating across India, such as Panasonic, Sumitomo, Nippon, NEC, Toyota, and others. The interaction was a key part of Punjab’s outreach in the run-up to the Sixth Progressive Punjab Investors’ Summit, scheduled for March 13-15, 2026, in Mohali, according to an official statement. Mann said Punjab is a land known for courage, resilience, hard work, entrepreneurship, creativity, and a strong sense of community. He said that Punjab has always played a major role in the country’s development, especially in making the country self-reliant in food production. Today, Punjab is moving forward with a renewed vision to become a leading centre for modern industry, technology, and global collaboration, he stated. Mann emphasized Punjab’s strong and growing ties with Japanese industry and extended a warm invitation to Japanese companies to be part of Punjab’s next phase of industrial transformation. He said Punjab and Japan share values of trust, discipline, and long-term partnership. Japanese companies in Punjab have already demonstrated strong success in the state, he added.
