Supreme Court of India NEW DELHI: “Lifespan of a criminal trial cannot be that of a turtle,” SC said Wednesday, taking exception to the over-three-year-long trial of an activist of the outlawed Popular Front of India (PFI) facing charges that entail a maximum five-year jail term, with no prospect of its early end because of 700 prosecution witnesses lined up against him.Petitioner Shahid Khan, who was arrested on Sept 22, 2022, has appealed against a Karnataka HC order rejecting his bail plea. NEW DELHI: “Lifespan of a criminal trial cannot be that of a turtle,” SC said Wednesday, taking exception to the over-three-year-long trial of an activist of the outlawed Popular Front of India (PFI) facing charges that entail a maximum five-year jail term, with no prospect of its early end because of 700 prosecution witnesses lined up against him.Petitioner Shahid Khan, who was arrested on Sept 22, 2022, has appealed against a Karnataka HC order rejecting his bail plea. The Supreme Court requested high courts to pass appropriate full-court resolutions in favour of increasing the age of superannuation of judicial officers from 60 to 62 years NEW DELHI: Attempting to bring judicial officers’ retirement age on a par with that for HC judges, the Supreme Court on Wednesday asked states to decide by Sept 2 on increasing the superannuation age of trial court judges from 60 to 62 years while brushing aside pleas of financial constraints and the disparity it would create vis-a-vis government employees.In the early 1990s, the Supreme Court had increased through a judgment the retirement age of judicial officers across India from 58 to 60 years. This time, however, a bench of CJI Surya Kant and Justices Joymalya Bagchi and V Mohana said that instead of a judicial ruling, it would be better if state governments made the decision on their own. The strength of trial court judges has doubled since 1992, from around 10,000 to over 20,000 at present. The number of HC judges has increased from 568 in 1992 to 1,114 now.A few states have increased the age of retirement for judicial officers from 60 to 61, akin to similar benefits for government employees. Some states argued that increasing the age of superannuation of judicial officers to 62 years would create disparity and cause discontent among government employees, who too would demand identical benefits, entailing a huge financial burden for the government.But the bench rejected both these objections. It said that when a judicial officer retires, the government pays them a lump-sum amount and pension, which is more than half of their last-drawn salary. On filling the vacancy, the government pays a salary to the new appointee. But we are of the opinion that the issue can be resolved amicably by administrative decisions of states,” the bench said.Asking advocates general of states to persuade their respective governments, the bench said, “States must revisit the issue of enhancing the retirement age of judicial officers irrespective of the present retirement age of government employees.”The Supreme Court requested high courts to strengthen the hands of state governments on the issue by passing appropriate full-court resolutions in favour of increasing the age of superannuation of judicial officers from 60 to 62 years.Get the latest India News and Live updates. Moved by finance minister Nirmala Sitharaman, the bill seeks to recognise digital and virtual records as admissible evidence in courts NEW DELHI: The Lok Sabha on Wednesday passed the Bankers’ Books Evidence Bill — replacing a British-era law — without discussion amid opposition protests and sloganeering on multiple issues, as members refused to heed the chair’s call to debate the legislation.The government accused the opposition of disrupting proceedings. Parliamentary affairs minister Kiren Rijiju accused Congress, Left parties and SP of being against Lord Ram and demanded they apologise to the nation. Referring to the opposition’s skit in Parliament, he said it had “saddened” the government and claimed these parties had opposed Ram temple construction by wearing black bands.Moved by finance minister Nirmala Sitharaman, the bill seeks to align the law with contemporary digital banking practices by recognising digital and virtual records as admissible evidence in courts. Replacing the Bankers’ Books Evidence Act, 1891, it expands the definition of ‘bankers’ books’ to include records maintained in physical, digital, virtual, cloud-based or any other form.Protests disrupted Question Hour, forcing an adjournment till 2pm. Union law minister Arjun Ram Meghwal also said India would soon have its first woman CJI NEW DELHI: The Rajya Sabha on Wednesday passed a bill by voice vote to replace an ordinance that increased the sanctioned strength of the Supreme Court from 34 judges to 38.
