(PTI Photo/Shahbaz Khan) New Delhi: Supreme Court on Tuesday came to the rescue of 12 life convicts, who had undergone a total sentence of 12 years in jail, acquitting all of them in a 2008 murder case in Assam by holding that proper investigation was not done by police.Pointing fault in the probe, which could have been because of “ignorance, inefficiency or malicious motivation”, the Supreme Court began its verdict by saying “an inept investigation or a scripted enquiry, both are fatal to criminal prosecution but the latter has lethal consequences when there is a possibility of totally innocent persons being crucified”. A bench of Justices Sanjay Kumar and K Vinod Chandran accepted advocate Talha Abdul Rahman’s petition, which pointed out various loopholes in the prosecution’s story. The court said there was no sufficient proof to prove culpability of the accused in the case and set aside the orders of the trial court as well as the Gauhati HC of conviction and sentence. It asked Assam govt to take steps to give proper training to its police force. “It is unfortunate that the police officer who reached the spot immediately after the incident took place, failed to follow due procedure to put the criminal investigation in motion as per the CrPC,” the bench said. “Be it ignorance, inefficiency or malicious motivation, the crime is left unresolved, and considerable time and money has been spent in the prosecution of 16 persons, some of whom died during trial and the others suffered incarceration for long periods,” it said. The state and its home department “would do well to better equip their officers in investigating crimes and educating them of due procedure”, the bench said. SC noted that despite police having reached the spot immediately after the assault, in which one person was allegedly killed and two others injured grievously, no attempt was made to collect the blood spilled at the spot, so as to match it with that of the deceased and the injured. WhatsApp New Delhi: Social media major WhatsApp has told the Union govt that it has deployed artificial intelligence-based logo detection and media matching system to identify and remove accounts impersonating law enforcement agencies to threaten senior citizens with ‘digital arrest’ and rob them of their life savings. Attorney general R Venkataramani filed the status report on behalf of Indian Cyber Crime Coordination Centre (I4C), operating under ministry of home affairs (MHA), after the interdepartmental committee deliberated measures to curb “digital arrest” scams with department of telecom, Reserve Bank of India, ministry of information technology, representatives of telecom service providers and WhatsApp. The statement of WhatsApp is significant as the encrypted messaging service has been used in diverse jurisdictions to avoid detection. On the discussion with the social media major, the status report said, “WhatsApp will continue strengthening AI/ML-based systems to detect impersonation of law enforcement agencies, misuse of official logos.” “WhatsApp informed that detection models and warning mechanisms have been introduced to identify impersonation patterns and alert users in suspicious interactions,” the report said, adding that the popular social media platform assured to undertake additional safeguards to detect and mitigate prolonged scam calls, as seen in digital arrest cases, and submit proposed technical measures within a month. “WhatsApp further ensured to cooperate with Law Enforcement Agencies and I4C, including timely action on shared signals related to scam networks, impersonation of law enforcement agencies, and fraudulent activities conducted through the platform,” it said. The status report detailed a series of steps under implementation – biometric identity verification prior to issuance of SIM cards by all telecom service providers (TSPs) and national database on SIM card holders of all TSPs. “DoT, in coordination with TSPs, to ensure that the technical system for national-level visibility of SIM issuance across operators is implemented within six months thereafter, so that the BIVS (Biometric Idenity Verification System)-based cross-operator SIM monitoring system becomes operational within a total period of nine months, before Dec 2026,” it said. (PTI Photo/Shahbaz Khan) New Delhi: With many students from disadvantaged sections still not getting admission in neighbourhood schools under Right to Education Act (RTE) because of disagreements between govt authorities and school managements, Supreme Court on Tuesday stressed that pending grievances cannot be a ground for educational institutions to deny admission to such students and the same can be dealt with subsequently. Emphasising that interests of students should not be hampered because of a tug-of-war between govt authorities and school managements, a bench of Justices P S Narasimha and Alok Aradhe said, “We find that schools, like the petitioner’s that may have some disagreement with the selection by govt, can make representation to the concerned authority, but they ought not wait for the outcome of such a representation and are mandated to grant admission to the student whose name finds mention in list forwarded to the school in the interregnum. (PTI Photo/Shahbaz Khan) New Delhi: With many students from disadvantaged sections still not getting admission in neighbourhood schools under Right to Education Act (RTE) because of disagreements between govt authorities and school managements, Supreme Court on Tuesday stressed that pending grievances cannot be a ground for educational institutions to deny admission to such students and the same can be dealt with subsequently. Emphasising that interests of students should not be hampered because of a tug-of-war between govt authorities and school managements, a bench of Justices P S Narasimha and Alok Aradhe said, “We find that schools, like the petitioner’s that may have some disagreement with the selection by govt, can make representation to the concerned authority, but they ought not wait for the outcome of such a representation and are mandated to grant admission to the student whose name finds mention in list forwarded to the school in the interregnum. Kerala’s Sabarimala Temple (File photo) New Delhi: Midway through the ‘faith vs fundamental right’ debate emanating from the customary ban on entry of women in the 10-50 years age group into the Sabarimala Ayyappa temple, a Hindu party on Tuesday requested a nine-judge Supreme Court bench to review its 30-year-old judgment declaring Hinduism as a “way of life”.Articulating the objection to the ruling in the 1996 Ramesh Yeshwant Prabhoo judgment by a three-judge bench that Hinduism “may broadly be described as a way of life and nothing more”, a lawyer appearing for the Hindu party said Hinduism is not a way of life, but a oceanic confluence and assimilation of infinite number of distinct religious beliefs and faiths.During the ninth day of proceedings before a bench of CJI Surya Kant and Justices B V Nagarathna, M M Sundresh, A Amanullah, Aravind Kumar, A G Masih, P B Varale, R Mahadevan and J Bagchi, advocate D V Singh said that in order to decide what constituted an essential Hindu religious practice, the court must decide what is “Hinduism and Hindu Dharma”, and suggested that SC could take help of the Bhagavad Gita for this.This mirrored senior advocate M R Shamshad’s request on Thursday to the nine-judge bench to review the 1994 Ismail Faruqui judgment by a five-judge bench, which while rejecting the challenge to govt acquisition of the then-disputed Ram Janmabhoomi-Babri Masjid site had ruled that mosque is not essential for offering namaz. He had said masjid is the spirit of Islam and constituted core belief of Muslims.In the Ramesh Yeshwant Prabhoo judgment, SC had said, “When we think of Hindu religion, we find it difficult, if not impossible, to define Hindu religion or even adequately describe it.””Unlike other religions in the world, Hindu religion does not claim any one prophet; it does not worship any one God;it does not believe in any one philosophic concept; it does not follow any one set of religious rites or performances; in fact, it does not appear to satisfy the narrow traditional features of any religion or creed. It may broadly be described as a way of life and nothing more,” the court had said.”Ordinarily, Hindutva is understood as a way of life or a state of mind, and it is not to be equated with or understood as religious Hindu fundamentalism… The words ‘Hinduism’ or ‘Hindutva’ are not necessarily to be understood and construed narrowly, confined only to the strict Hindu religious practices unrelated to the culture and ethos of the people of India, depicting the way of life of the Indian people,” it has said in the judgment.In the Ismail Faruqui judgment, SC had ruled, “A mosque is not an essential part of practice of the religion of Islam and Namazby Muslims can be offered anywhere, even in the open.
