SC seeks reply from govt for 'not utilising' Rs 1,000cr green fund
SC asked the Centre and CPCB to provide details of how the over Rs 1,000-crore Environment Protection Fund was used

NEW DELHI: Supreme Court Tuesday asked the Centre and Central Pollution Control Board (CPCB) to provide details of how the over Rs 1,000-crore Environment Protection Fund (EPF), which was set up in 2008 to compensate people affected by hazardous substances, was utilised.Expressing surprise at a PIL by Gyan Prakash alleging that no compensation had been paid from the fund, a bench headed by CJI Surya Kant also asked govt and CPCB to explain how it proposes to use the corpus built over the years.Instituted under Public Liability Act, 1991, which was enacted following the Bhopal gas tragedy, the primary purpose of EPF is to offer immediate relief to victims and those injured in accidents involving hazardous substances. Prakash said there had been many incidents of oil tankers catching fire, but those who lost their lives or were injured did not get anything from the fund.The 35-year-old law requires industries producing or handling hazardous material to mandatorily obtain public liability insurance. Apart from contributions from these industries, EPF gets funds from compensation awarded by National Green Tribunal for damage caused to the environment. The court was informed that the fund has been managed by CPCB from 2024.

The session was adjourned amid ruckus NEW DELHI: Parliament proceedings were washed out for the second consecutive day Tuesday as opposition members continued with their protests inside Lok Sabha and Rajya Sabha over multiple issues, including police lathi-charge on those protesting NEET paper leak and alleged Ram temple donation theft. Both Houses were adjourned for the day after witnessing repeated disruptions.As soon as Lok Sabha took up the first question at 11am, opposition MPs started raising slogans despite being assured by Speaker Om Birla that they would get time to raise their issues as per rules. Birla, however, adjourned proceedings till 12 noon when the MPs did not relent.Similar scenes prevailed when the House reassembled. Ministers laid parliamentary documents amid the din before LS adjourned for the second time till 2pm and later for the day.Rajya Sabha too witnessed similar scenes and multiple adjournments before finally adjourning for the day. Earlier, after official papers were laid on the table of the House, leader of the opposition Mallikarjun Kharge rose to speak on the police action against students, alleging that they were lathi-charged and police also used tear gas Monday.His remarks triggered slogan-shouting by treasury bench members. Netaji Subhas Chandra Bose ’s octogenarian Germany-based daughter, Anita Pfaff, moved Supreme Court NEW DELHI: Three months after a failed attempt by his grandnephew, Netaji Subhas Chandra Bose’s octogenarian Germany-based daughter, Anita Pfaff, moved Supreme Court Tuesday seeking a direction to govt to bring his ashes back from the Renko-Ji temple in Japan.Pfaff’s petition, settled by senior advocate A M Singhvi, complained of “India’s prolonged failure to take a final, reasoned and time-bound decision” to repatriate to India the “mortal remains/ashes attributed to Netaji, preserved at Renko-Ji temple” to allow the sole living direct lineal descendant to perform his last rites with dignity and finality.”There is gross delay,” said a bench of CJI Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi. However, it adjourned the hearing on Pfaff’s petition on finding the arguing counsel absent.Ahead of the West Bengal assembly elections, a petition was filed in SC by Netaji’s gr-andnephew, Ashis Ray, seeking the same direction to the Centre. Appearing for Ray, Singhvi had argued before the bench of the same three judges on March 12 that the petition had the support of Pfaff, who joined the proceedings virtually.Singhvi had said the fact that every head of state from India, over decades, had paid obeisance at Renko-Ji temple was proof that the freedom fighter’s ashes were there. The CJI-led bench had said there was no doubt that he was one of the country’s greatest freedom fighters, but refused to entertain Ray’s plea.Justice Bagchi had said, “We respect her (Pfaff’s) sentiments and we will ensure that her sentiments are translated into legal action. But she must step forward.”Singhvi had withdrawn the petition. The bench asked the SEC to come out with an election schedule by Friday. NEW DELHI: Supreme Court Tuesday sought Maharashtra State Election Commission’s response by Friday on issuance of a notification to conduct polls in Aug-Sept for remaining 20 zila parishads and 211 nagar panchayats and brushed aside SEC’s ongoing SIR exercise as the reason for the delay in holding polls.Senior advocate Balbir Singh, appearing for SEC, told a bench of CJI Surya Kant, and Justices Joymalya Bagchi and Vipul M Pancholi that most of state govt officers, who are likely to be engaged in the election work related to zila parishads and nagar panchayats, are at present engaged in carrying out the SIR of poll rolls in the state.When the SEC said it intended to conduct these elections in Feb-March next year after the completion of SIR work, the bench said SIR is conducted by EC and not SEC. “We will ensure you get adequate manpower,” it said.The bench asked the SEC to come out with an election schedule by Friday.The batch of matters before the bench raised myriad yet sensitive issues. One challenged the transposition of socially and economically backward classes (SEBC), identified for reservation in govt employment and admission to govt schools and colleges, with reserving constituencies in elections. It said OBCs are politically advanced and powerful in most of the states and a five-judge SC bench in its 2010 judgement in Krishna Murthy case had mandated that constituencies should be reserved for politically backward sections.Get the latest India News and Live updates.
