New Delhi: As he held talks with visiting Austrian Chancellor Christian Stocker, PM Narendra Modi stressed that India and Austria backed stable, sustainable and lasting peace in Ukraine and West Asia, reiterating that military conflict will not resolve issues. The visit, the first by an Austrian chancellor in 42 years, saw over a dozen agreements and announcements across counterterrorism, military affairs and technology.In his media statement, Modi said the world was going through a serious and tense situation, with its impact felt by all. “In such a tense global environment, India and Austria are in agreement that solutions cannot be achieved through military conflict. Whether in Ukraine or West Asia, we support a stable, sustainable and lasting peace,” he said, adding both sides agreed global institutional reform was essential.On West Asia, MEA secretary Sibi George said both sides underscored dialogue and diplomacy, including safe, unimpeded maritime passage. On Ukraine, they backed a comprehensive and lasting peace based on the UN Charter and international law.Modi said eradicating terrorism remained a shared commitment. India and Austria signed a LoI to establish a Joint Working Group on Counterterrorism and condemned terrorism in all forms, including cross-border terror, Pahalgam attack and the Red Fort incident. Another LoI will provide an institutional framework for military cooperation and defence technology partnership, building on the India-EU Defence and Security Partnership.Bilateral ties received a boost in 2024 with Modi’s Vienna visit, the first by an Indian PM in 41 years. New Delhi: A spouse being in an extramarital relationship cannot be a ground to prosecute the partner if he/she commits suicide due to strain in the relationship, SC Thursday said, adding that abetment to suicide requires a positive act of instigation.A bench of Justices K V Viswanathan and Atul Chandurkar said that to sustain a charge under Section 306 of the penal code, it must be shown the accused contributed to the suicide through a direct or indirect act, with intent. Abetment requires an active act which leaves the deceased with no other option but to take their life.Quashing the case against a man allegedly in a relationship with the deceased’s wife, SC said even if illicit relations are assumed, the mens rea to abet suicide was absent. “There is no allegation that appellant had instigated him to commit suicide or aided any act or illegal omission to bring about the suicide,” bench said.The top court set aside a Chhattisgarh HC order allowing trial on the ground that the deceased was upset with his wife’s alleged relationship. ‘Anil Ready To Discuss, Settle With Banks’ New Delhi: Supreme Court Thursday dismissed three appeals filed by beleaguered industrialist Anil Ambani and Reliance Communications (RCom) for stay of proceedings related to ‘fraud tagging’ of their bank accounts following a forensic review of debts and alleged diversion and siphoning of loans by ADAG group to the tune of Rs 30,000 crore.For 45-minutes, senior advocates Kapil Sibal, Shyam Divan and Narender Hooda laboured hard before a bench of CJI Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi to drive home the point that the financial audit of the accounts, as per RBI circular, can only be carried out by a qualified chartered accountant, a mandate which was violated by appointment of forensic auditor in BDO India LLP, which is not a CA.The declaration of an account as fraud carries enormous civil and criminal consequences and hence the rule must be strictly adhered to, they argued. “It is a case of diversion and siphoning of thousands of crores of rupees from the bank loans. We do not want to express any opinion except saying that the decision of a division bench of the Bombay HC does not warrant any interference,” the CJI-led bench said.Appearing for a consortium of banks, including Bank of Baroda, Indian Overseas Bank and IDBI, solicitor general Tushar Mehta said the forensic auditor is an expert in the field and carries high reputation in India and abroad. The bench said, “The division bench has considered in detail the inappropriateness of single judge bench granting stay on the ‘fraud tagging’ proceedings and found that the petitioners do not even have a prima facie case.”When Sibal said that declaring an account fraudulent would mean financial assistance cannot be availed by the person or company, the bench said, “If there is a procedural flaw in declaring your accounts fraudulent, then in the pending suit you will have the right to seek a fresh audit.”After failing to convince the bench to grant relief to Ambani and RCom, Sibal said Ambani is ready to discuss with banks and settle the outstanding amount. “The banks have settled such cases earlier. I can offer Rs 5,000-8,000 crore for settlement. Please record this in the court order,” Sibal requested.Mehta opposed even recording of Ambani’s statement on willingness to settle saying this would be used as a window to reopen the entire case and start new litigations.
