New Delhi: Observing that the discharge of an accused in a criminal case stands on a “better footing” than acquittal, the Supreme Court has held no disciplinary or administrative action can be initiated against a discharged person.Busting the myth that an accused, unless he is acquitted, carries the label of being accused, a bench of Justices Dipankar Datta and K V Viswanathan said that such an understanding of law is fallacious. “It is not the law that an accused, unless he is acquitted, must still carry the label on his forehead that he is accused of a criminal offence. Once an accused has been discharged, he is entitled to avail of all benefits that are otherwise available to an acquitted person and cannot be placed in a less advantageous position,” SC said.The court said a discharge is on a higher pedestal than an acquittal. “Acquittal is at the end of the trial process, maybe for a technicality or on benefit of doubt or (because) the prosecution could not prove the charge against the accused; but when an accused is discharged, it means that there are no materials to justify launch of a criminal trial against the accused. Once he is discharged, he is no longer an accused,” the bench said, while referring to SC’s previous verdict. “Discharge is a pre-trial termination of proceedings for lack of evidence. T’puram: Nearly two years after the Mundakkai-Chooralmala landslides devastated parts of Wayanad, records accessed under the RTI Act show that the Kerala govt has directly spent only Rs 102.6 crore from its own funds for relief and rehabilitation, reports KP Saikiran.According to the disaster management department’s response, this entire amount was drawn from the state disaster response fund. With estimates indicating that rebuilding Wayanad would require several thousand crores, criticism has already emerged that the state’s direct financial commitment remains disproportionately low compared to the scale of the disaster.The Kerala govt has maintained it fully availed the Rs 529.5 crore interest-free loan the Centre had sanctioned for Wayanad’s rehabilitation. However, there is still no publicly available breakdown of how this amount has been utilised. Documents from the revenue department further show that donors from across the world had contributed nearly Rs 774 crore to the CM’s distress relief fund.Of this, Rs 167 crore has been allocated to the Wayanad district collector. A significant portion of this allocation has gone towards land acquisition for a rehabilitation township.Despite the allocations, there has been no meaningful progress in terms of the liveability of the houses, with basic infrastructure such as power and water connections still not in place. Apart from the symbolic handover of keys for a few houses ahead of polls, the township project remains incomplete. Kolkata: West Bengal State Electricity Distribution Company is planning to procure a substantial number of diesel generator (DG) sets and UPS units on a rental basis from neighbouring states like Assam and Bihar.This will be done to ensure an uninterrupted supply of power at polling stations. The state will have 85,379 polling booths at 55,000 polling premises. The Election Commission has directed power companies to ensure continuous supply on voting days.”Out of the 55,000 polling premises, DG sets or UPS units will be deployed in 40,000 locations. In Kolkata, Salt Lake and Siliguri, these backup systems will be stationed at sector offices and dispatched immediately to polling stations as required,” a power official said.EC has expressed concern after discovering that a few hundred polling stations, including about 100 in Kolkata, don’t have electricity ahead of polls. Officials said the lack of power could severely impact webcasting that has been mandated to ensure transparency.The poll body has also directed district election officers to immediately restore electricity at these locations. In places that can’t have direct electricity connections, alternative arrangements have been made. Authorities have been told to ensure no booth should be affected due to the power crisis on polling day, EC sources said.According to sources, the highest number of such booths (50) has been identified in the Kolkata Port constituency. This has raised questions about past polling arrangements in these areas. It has also sparked criticism of infrastructure preparedness.Another power official said on average, 8-10 ICDS centres in each district lack electricity. “These centres usually don’t need power supply as they operate during the day. Authorities have been told to ensure no booth should be affected due to the power crisis on polling day, EC sources said.According to sources, the highest number of such booths (50) has been identified in the Kolkata Port constituency. This has raised questions about past polling arrangements in these areas.
