NEW DELHI: India has decided to bid to host the 2036 Olympics, and efforts are being made to address gaps in sporting infrastructure in the country and develop world-class facilities to host international events of such scale, Union sports and youth affairs minister Mansukh Mandaviya said on Thursday.Speaking at an event, Mandaviya said an analysis was done to identify gaps in sports infrastructure in the country, and a working plan was prepared to create facilities on par with the international level. “We will also bring the infrastructure owned by different central, state, and private entities under one umbrella and analyse where we need to strengthen it,” the minister said, adding the Delhi-based Jawaharlal Nehru stadium will soon be turned into a sports city of a global standard.The minister added that the govt will soon announce a new scheme for sports equipment and sports goods manufacturing. Mandaviya said the recent visit of international soccer star Lionel Messi to various Indian cities gave a push to sports culture in the country. “In the coming years, you will see the medals tally improving and India getting more laurels at the international level,” he said. Regarding mismanagement at certain venues that hosted Messi, he said the organisation of such events was slowly improving. “We recently organised the World Para-athletic Championship. Arranging facilities at such an event is not easy, but we managed to organise it pretty well,” he said.The minister, who also holds the charge of the labour and employment ministry, outlined the govt’s decision to repeal 26 labour laws and replace them with four consolidated labour codes. Hospitals told to make public their kidney transplant success rate NEW DELHI: Kidney transplant hospitals will now have to publish patient survival rates, deaths, graft failures and other long-term results, ending a system that left patients to choose where to undergo surgery without knowing how centres performed. The National Organ and Tissue Transplant Organisation (NOTTO) has directed transplant centres across the country to put the figures on their websites after BJP MP Captain Brijesh Chowta spotlighted the lack of transparency on transplant outcomes. NOTTO director Dr Anil Kumar directed state and UT authorities to ensure every transplant hospital prominently displays post-transplant outcome data on its website and submits complete and timely follow-up data to the National Organ and Tissue Transplant Registry. Hospitals have also been asked to give patients and their families or guardians full information about the procedures being undertaken — as well as its risks and likely outcomes — before taking consent. In his representation to the Union health minister, Captain Chowta had flagged gaps in tracking long-term outcomes of kidney transplant cases, citing a report submitted by two Mangaluru-based citizens. The MP said public attention largely focuses on successful transplants, while long-term complications, graft failures and post-transplant deaths remain inadequately tracked. The letter also highlighted the absence of a national registry to monitor long-term outcomes, arguing that greater transparency would help patients make informed decisions. Dr Anupam Roy, the additional director of nephrology and kidney transplant at Aakash Hospital in Dwarka, Delhi, said: “Making transplant outcomes public is a landmark step towards transparency and accountability. It will empower patients with objective information… However, these results must be interpreted in the context of patient complexity and risk profile”. NOTTO said 824 transplant centres are currently linked to the organ and tissue transplant registry and are required to record transplant and follow-up data through designated login credentials. Comprehensive reporting, the organisation said, would strengthen monitoring of transplant outcomes, improve traceability and support evidence-based policy decisions. Under the standard reporting format, hospitals will have to disclose the number and percentage of patients alive, deaths, graft failures and patients lost to follow-up at discharge — six months, one year, three years and five years after the kidney transplantation.Get the latest India news and live updates. Homebuyers can seek relief for delay after possession: Supreme Court NEW DELHI: Taking possession of a flat would not bar homebuyers from raising complaints against real estate companies for deficiency in services. Supreme Court has held that homebuyers can approach consumer forums against developers to seek compensation for delayed possession even after taking custody of the flat. The SC set aside an order of National Consumer Disputes Redressal Commission (NCDRC) which had held that ahomebuyer ceases to be a consumer after taking possession of the flat and could not seek compensation for delay. SC also held that the arbitration clause in homebuyer-real estate company agreement would not block the former from approaching the consumer forum to raise grievances. Twenty-two years after a homebuyer got possession of his flat housing project in Dwarka in NCR, a bench of Justices Vikram Nath and V Mohana allowed his plea to seek compensation for delay in handing over the flat. It said the NCDRC’s reasoning “cannot be sustained”.“The appellant’s complaint was not for delivery of possession simpliciter. His grievance was that there had been delay in handing over possession of the flat and that he was entitled to compensation for such delay. A claim for compensation for delayed possession necessarily arises from the period prior to the actual delivery of possession. The subsequent receipt of possession cannot, by itself, extinguish the right of the allottee to seek adjudication of a claim for compensation for the alleged delay,“ the bench said. The bench revived the 2005 complaint filed by the homebuyer before the district consumer forum and asked it to decide within a year whether there was any delay. It also asked the forum to decide whether such delay was attributable to the respondent, whether the appellant had accepted possession unconditionally, and whether any compensation is payable. “The claim of the appellant for compensation on account of alleged delay in handing over possession has neither been accepted nor rejected after evidence. Equally, the defence of the respondent society has also not been examined on merits. These issues could not have been concluded at the threshold by holding that the appellant ceased to be a consumer merely because possession had been delivered before the complaint was filed. In such circumstances, it would not be appropriate for this court to record any finding on the factual controversy between the parties,” the bench said. Adjudicating on what should be given primacy – arbitration clause in agreement or Consumer Protection Act – the bench said the 1986 Act creates a special and additional remedy for consumers and the jurisdiction so conferred could not be displaced merely by reference to an arbitration agreement between the parties. “Once that mechanism is validly invoked and the complaint is admitted, the consumer cannot be driven out of that forum merely because the agreement between the parties contains an arbitration clause. A private contractual clause cannot be permitted to defeat the continued operation of a statutory remedy which Parliament has expressly made additional to other remedies under Section 3 of the 1986 Act,” it said.Get the latest India news and live updates. In such circumstances, it would not be appropriate for this court to record any finding on the factual controversy between the parties,” the bench said. Adjudicating on what should be given primacy – arbitration clause in agreement or Consumer Protection Act – the bench said the 1986 Act creates a special and additional remedy for consumers and the jurisdiction so conferred could not be displaced merely by reference to an arbitration agreement between the parties. “Once that mechanism is validly invoked and the complaint is admitted, the consumer cannot be driven out of that forum merely because the agreement between the parties contains an arbitration clause. A private contractual clause cannot be permitted to defeat the continued operation of a statutory remedy which Parliament has expressly made additional to other remedies under Section 3 of the 1986 Act,” it said.Get the latest India news and live updates. 2 states, 2 different rules for registration of doctors NEW DELHI: Two states have come up with two different models when it comes to allowing doctors to practise in their jurisdiction. While Andhra Pradesh has facilitated interstate practice, Maharashtra has retained verification safeguards, reviving debate over a national registration framework for medical practitioners. On June 11, Andhra Pradesh govt allowed doctors registered with any State or Union Territory Medical Council to practise in the state without obtaining a separate registration or No Objection Certificate (NOC). The move, part of state’s deregulation reforms, removed a long-standing requirement that often delayed doctors moving across states. Days earlier, on June 5, Maharashtra Medical Council adopted a different approach. It removed the need for doctors to obtain an NOC themselves but retained registration and verification requirements. The council now directly seeks verification from the parent state council and grants provisional registration pending clearance. AP Medical Council member Dr Daggumati Sreehari Rao said the order does not eliminate oversight. Doctors from other states will still have to apply online, disclose their registration details and declare any disciplinary proceedings against them. The council will verify these details with the parent state council before permitting medical practice. Rao said detailed procedures for the system are still being finalised. The debate has gained momentum since National Medical Commission examined a proposal to allow Armed Forces Medical Services doctors, who are frequently transferred, to practise nationwide on the basis of a single registration. Supporters of the stance say multiple state registrations create unnecessary barriers for doctors. RTI activist Dr Babu V said Andhra Pradesh’s decision could provide a template for wider reform. “Disallowing doctors from serving where they are needed because of bureaucratic registration requirements is not in the best interests of patients or the nation. If NMC can consider nationwide practice rights for armed forces doctors, the same principle can be extended to all registered doctors,” he said. IMA president Dr Anil Kumar J Nayak, however, cautioned against removing verification safeguards. “Registration can be simplified, but accountability cannot be compromised.
