New Delhi: In an unprecedentedly swift process, Union govt completed the formalities for appointment of Chief Justice of India within seven days of initiating the process as on Thursday President Droupadi Murmu designated Justice Surya Kant as the next CJI. He will take oath on Nov 24.Union law minister Arjun Ram Meghwal had sent a letter to CJI B R Gavai on Oct 24 seeking his recommendation for the next CJI. Immediately after reaching Delhi from an official visit to Bhutan, CJI Gavai on Oct 27 recommended appointment of Justice Kant, the most senior SC judge, as next CJI. Image credit: AP NEW DELHI: While 82% of the census houselisting work is already complete in the national Capital, the enumerators are dealing with a different challenge: reluctance on part of certain sections — migrants, occupants of “unauthorised” settlements and owners of residential buildings with multiple rented units — to enumerate due to preconceived notions and misplaced fears about the individual census data being used to penalise them.As per the Census Act 1948, individual data collected during the census is kept strictly confidential and only the aggregated data at various administrative levels is made public. This allows people to record their housing and individual data freely and correctly, reassured that it will not be shared with any law enforcement agency or regulatory body. The accurate datasets serve as the foundation for evidence-based planning, policy formulation and targeted welfare interventions.Officials involved in enumeration for the houselisting phase, which ends in Delhi (MCD area) on June 14, told TOI that the refusal of certain sections to be enumerated cuts all districts/areas including East Delhi, Northwest Delhi, Northeast Delhi, Southwest Delhi, Outer Delhi etc. A senior census functionary said this is “due to half-baked understanding of census rules and procedures, which we are trying to correct through awareness activities like nukkad natak (skits) and dialogue with involvement of the district administration and community leaders”.The official said some migrants are unwilling to be enumerated in the aftermath of special intensive revision (SIR) that saw nearly 5.2 crore deletions in Phase 2. Since many retain aadhaar and name in the electoral roll in their native place or may have settled in Delhi’s authorised colonies, they are reluctant to enumerate, fearing they will lose their documentation from their home state and also face action for squatting. “Fear of being penalised by tax or civic authorities sits in the minds of owners of private houses in unauthorised colonies and in coaching havens like Mukherjee Nagar where a large number of students live on rent in poor living conditions,” said the officer.Another challenge for enumerators is entering large residential complexes where the owner resides with scores of tenants occupying other rooms. “Fearing scrutiny, the owner insists on the entire building being recorded as a single household comprising only his immediate family. Enumerators are not given access to other rented rooms in the complex, and sometimes threatened,” an officer said and added that the census staff are talking to the owners to convince them. “In some cases, we have had the district administration deploy civil defence volunteers to accompany the enumerator for safety,” said the officer.With 10 days to go before the houselisting phase ends in Delhi, census authorities have asked enumerators to go back to the reluctant sections to reassure them about privacy of individual data and emphasise how 100% coverage of Delhi’s over 46,000 enumeration blocks is essential to future policy interventions. “They have been able to convince some, though others are more stubborn,” said an official.The officer said similar challenges would have been faced in earlier census exercises as well. “The percentage of persons unwilling to participate in the census is not significant, but then the effort is always to cover 100% households and record data with least errors,” the officer told TOI.About the AuthorBharti JainBharti Jain is senior editor with The Times of India, New Delhi. CJI Surya Kant (Source: ANI) NEW DELHI: CJI Surya Kant on Friday said though Artificial Intelligence tools are reshaping exercise of sovereign and judicial powers, the international community must quickly devise a legal framework to deal with a concerning flipside of AI-driven activities, which when carried out it one country, can cause significant territorial consequences for another.Delivering a public lecture at University of London, CJI Kant said AI is an operational reality that is reshaping governance, commerce, warfare, communication, public administration, and increasingly, the exercise of judicial and sovereign power itself.Flagging the jurisdictional limitations to regulate AI driven activities, the CJI said International Law must increasingly attempt to confront such forms of AI-moulded powers “that are no longer neatly contained within geography yet continue to produce deeply territorial consequences for individuals and societies”.He said, “If jurisdiction determines where power operates, liability determines who must answer for its consequences. Artificial Intelligence destabilises both simultaneously.”AI systems, however, frequently operate through distributed chains involving developers, data suppliers, deployers, cloud infrastructure providers, private corporations, and sovereign actors spread across multiple jurisdictions, thus creating an accountability vacuum, he said.The CJI asked – “When an autonomous system causes harm, who bears responsibility? Is liability attributable to the developer who designed the architecture? The entity that deployed the system? The sovereign government that authorised its use? Or the institution that supplied the underlying data upon which the algorithm was trained?”He said the significance of the issue heightens in the context of autonomous weapon systems and military application of AI, which complicate the attribution of intent and decision-making as the present legal system is on fastening it on the persons who implemented and those who took the decision.As even the developers of AI-based implements are unable to explain why their machines did certain things on some occasions, the task of attributing accountability and providing remedy through a legal framework becomes difficult, he said.CJI Kant said, “The challenge before the international community is therefore not merely to regulate technological capability, but to preserve legal responsibility in environments where decision-making is increasingly mediated through algorithmic systems. If responsibility becomes too fragmented to identify, accountability itself risks becoming illusory.”“And that danger extends beyond warfare. Financial markets, healthcare systems, transportation networks, and critical public infrastructure are increasingly dependent upon automated systems capable of producing large scale consequences. Bombay HC NEW DELHI: A poor woman sought a DNA test on a man to prove that her daughter was born to him. In 2006, the man agreed to undergo the test but said the woman seeking the medical examination must bear the cost. The woman didn’t have the money. The trial court and Bombay HC had dismissed her plea.Two decades later, the daughter after reaching adulthood moved the Bombay HC seeking DNA test of the man and herself in quest of her paternity and said she was ready to bear the expenses of the medical tests. But the HC said the judicial orders passed two decades ago have attained finality and these cannot be challenged now.The daughter through advocate Vatsalya Vigya told a bench of Justices P S Narasimha and Aravind Kumar that in 2006 the petitioner was a minor and now she is an adult and can bear the expenses of DNA test of herself and the man to prove paternity. The bench issued notice to the man, who is an advocate, and sought his response by Sep 18.Petitioner said her maternal grandfather was working in a colliery in Chandrapur, Maharashtra and became unfit to work in 2002. To get appointed in his place on compassionate grounds, her mother sought help from an advocate to file a case. The advocate, promising to marry her, established physical relations with her and because of that she became pregnant and the petitioner was born in 2003. But the man refused to keep his promise.As the biological father refused to acknowledge the relationship with the daughter, the petitioner’s mother had moved the court seeking alimony and DNA test. But with the man refusing to bear the expenses of the DNA test, and the petitioner’s mother having no financial wherewithal, the trial court rejected her application in 2006.In 2023, the petitioner, on attaining majority, filed an application seeking DNA test of the man and herself to examine paternal relations between them. This was opposed by the advocate. The trial court rejected the plea.
