NEW DELHI: Govt has stepped in to unclog piling up of containers at India’s busiest container port, Jawaharlal Nehru Port Authority (JNPA) (Mumbai), and has set up a panel of top officials to remove bottlenecks at all the 12 major ports. It will meet every week or fortnight to address concerns faced by businesses.The issue of around 35,000-40,000 inbound containers piled up at the JNPA was taken up at a review meeting chaired by commerce minister Piyush Goyal and shipping minister Sarbananda Sonowal. All India Liquid Bulk Importers and Exporters Association representatives attended the meeting.TOI has learnt pile up was due to the inadequate number of lorry drivers available for handing this cargo. NEW DELHI: Supreme Court on Friday agreed to hear a PIL by parents and teachers in NCR and Chennai challenging the validity of CBSE’s recent policy mandating three languages, two of which must be Indian for Class 9 and said it would lead to chaos and confusion.Seeking urgent hearing of the PIL, senior advocate Mukul Rohatgi told a bench of Chief Justice Surya Kant, Justices Joymalya Bagchi and Vipul M Pancholi that suddenly, Class 9 students were being made to compulsorily study two more languages. “How do the students cope with this and appear in the language paper examinations? This will create chaos and confusion among students and teachers,” Rohatgi said.The CJI-led bench assured that it would hear the petition next week. The petition, jointly filed by 17 parents and two teachers of children studying in Delhi, Noida, Gurgaon and Chennai in CBSE-affiliated schools through advocate Shradha Deshmukh, contended that the new policy was contrary to CBSE’s April 9 notification categorically assuring that third language was “not applicable till the academic session 2029-30 at the Class 9 level”.However, on May 15, after the commencement of academic session for 2026-27 and language allocations having been made and timetables finalised, the switch to three languages, of which two must be Indian, would cause irreversible harm to thousands of Class 9 students and would take away livelihoods of many teachers proficient in teaching foreign languages as they would have to make way for teachers who can teach regional languages, the petition said. With education and economic empowerment, there is social mobility. So then again to seek reservation for the children, we will never get out of it. That is a matter we have to be concerned about. Also, what is the use then? You are giving reservation. The parents have studied, they are in good jobs, they are getting good income, and the children want reservation again. See, they should get out of reservation,” SC said. Plea in SC: No quota cert citing creamy layer The bench of Justices B V Nagarathna and Ujjal Bhuyan indicated wards of well-off families should be kept out of the purview of OBC quota. It was hearing a plea of a person who was selected for appointment as an assistant engineer (electrical) in Karnataka Power Transmission Corporation in reserved category. NEW DELHI: Observing that a person is legally entitled to dispose of his property as he wishes, Supreme Court has ruled that a will cannot be invalidated just on the ground that legal heirs have been denied a share, reports Amit Anand Choudhary.A bench of Justices Ujjal Bhuyan and Vijay Bishnoi said the exclusion of natural heirs from a property, by itself, cannot be construed as a suspicious circumstance and dismissed the plea of the wife and children of a chartered accountant challenging the validity of his will.Unless exclusion of legal heirs is accompanied by suspicious circumstances affecting the genuineness or execution of the will, the exclusion alone does not render a will invalid, SC said. It noted that the will in question clearly specified that the testator has not done any injustice to his wife, children, or other relatives, and that he has given enough to them.In the will made in 1983, the CA bequeathed all the scheduled properties in the favour of his only sister. He died just six months thereafter and then started a legal battle among family members which went on for 43 years before it was finally adjudicated by the apex court.”The contention of the appellants (wife, children) that they, being the natural heirs of the testator, have been outrightly excluded without any reason and that such exclusion constitutes a suspicious circumstance surrounding the execution of the will is legally untenable. It is well-established that mere deprivation of natural heirs, by itself, may not amount to a suspicious circumstance because the whole idea behind the execution of a will is to interfere with the normal line of succession,” it said.The CA’s will, the bench said, “was duly executed by the testator voluntarily out of his free will in a sound state of mind and the same stands proved through the testimony of one of the attesting witnesses who was examined by the trial court. NEW DELHI: Observing that a person is legally entitled to dispose of his property as he wishes, Supreme Court has ruled that a will cannot be invalidated just on the ground that legal heirs have been denied a share, reports Amit Anand Choudhary.A bench of Justices Ujjal Bhuyan and Vijay Bishnoi said the exclusion of natural heirs from a property, by itself, cannot be construed as a suspicious circumstance and dismissed the plea of the wife and children of a chartered accountant challenging the validity of his will.Unless exclusion of legal heirs is accompanied by suspicious circumstances affecting the genuineness or execution of the will, the exclusion alone does not render a will invalid, SC said. It noted that the will in question clearly specified that the testator has not done any injustice to his wife, children, or other relatives, and that he has given enough to them.In the will made in 1983, the CA bequeathed all the scheduled properties in the favour of his only sister. He died just six months thereafter and then started a legal battle among family members which went on for 43 years before it was finally adjudicated by the apex court.”The contention of the appellants (wife, children) that they, being the natural heirs of the testator, have been outrightly excluded without any reason and that such exclusion constitutes a suspicious circumstance surrounding the execution of the will is legally untenable. It is well-established that mere deprivation of natural heirs, by itself, may not amount to a suspicious circumstance because the whole idea behind the execution of a will is to interfere with the normal line of succession,” it said.The CA’s will, the bench said, “was duly executed by the testator voluntarily out of his free will in a sound state of mind and the same stands proved through the testimony of one of the attesting witnesses who was examined by the trial court. ‘Can’t Be Grand Generalisation For Giving Bail’ NEW DELHI: Amid an escalating fight between two benches over whether delay in trial entitles those facing grave charges under UAPA to bail, Centre on Friday put a pointed poser to Supreme Court – could dreaded terrorists like Ajmal Kasab and Hafiz Saeed be allowed bail just because of delay in trial?Questioning the court’s verdict that delay in trial and long incarceration could be grounds for bail under special laws like PMLA and UAPA, additional solicitor general S V Raju and advocate Rajat Nair, appearing for Centre, said there cannot be a grand generalisation to grant bail on grounds of delay, and the nature of offence and individual’s role in it has to be examined, as done by the court while it granted bail to five accused in the 2020 Delhi riots case but declined the relief to Umar Khalid and Sharjeel Imam.”In the Ajmal Kasab case, there was a delay as there were a large number of witnesses in the case. Will you grant him bail on the ground of delay?
