NEW DELHI: After 35 years without a single witness being called to record oral evidence, the Supreme Court has stayed the trial proceedings against a police officer, indicating that it was in favour of quashing the case on the ground of delay alone. A bench of Justices J B Pardiwala and Vijay Bishnoi issued notice to Uttar Pradesh govt seeking its response on why the case should not be quashed. The officer is facing trial for charges under Sections 147 (rioting), 323 (causing hurt) and 504 (insult) of IPC and Section 120 of the Railway Act. KOLKATA: With last-minute relief following the publication of the appellate tribunal’s supplementary list on Wednesday, a few of the 139 lucky voters, who had lost hope, finally got their index fingers inked.Ainul Miah (30) from Cooch Behar was able to cast his vote at a booth under the Sitalkuchi assembly constituency. “My sister and I had both submitted all our documents, including our house deed, but our names were struck off. I am happy that I could finally vote,” he said.But the relatives of many of the lucky ones did not get to exercise their franchise. Ainul’s sister’s case is yet to be resolved. “My other siblings and my father voted as their names are in the final roll, but I am still concerned for my sister,” he said. Ainul added, “This is my fundamental right, which I lost under the category of logical discrepancy, where I had no role.Twin brothers Sk Kismat and Sk Kurban also got their names on the rolls after the appellate tribunal’s supplementary list was published.In their family of seven, the names of all five brothers had been deleted. Three were later restored on the rolls. Relief for Kismat and Kurban came 24 hours before the first phase of polling.Kismat said, “We went together to celebrate this hard-earned victory. We had submitted valid proof at the time of the hearing, but all our names were deleted. We did not think we would be able to vote this time. We are very relieved that we could participate in the polling process.”Dhananjay Sardar (30), who lives in a small village in Murshidabad, had his name included on the electoral rolls on Wednesday. Expressing relief after casting his vote, he said, “I was worried even after my name appeared, but everything went smoothly.”Biplab Majumder, a teacher from Malda, was not as lucky. NEW DELHI: Congress functionary TN Prathapan has approached the Supreme Court, alleging violation of the model code of conduct due to the broadcast of PM Modi’s April 18 speech by state-run channels Doordarshan and Sansad TV.The petition, which lies in defect as per its status on the SC website, claimed the PM’s speech, blaming opposition parties for the defeat of the 131st Constitutional amendment bill, was used to influence voters during the ongoing elections. It is alleged that the use of publicly funded broadcasters to air a political speech amounted to the misuse of official machinery.The plea said this fell within the definition of corrupt practice under section 123(7) of Representation of People Act, which barred the use of government machinery for electoral purposes. NEW DELHI: Justice Ahsanuddin Amanullah, part of a nine-judge Supreme Court bench, on Thursday said everyone must know that since the days of the Prophet, there was no ban on entry of women into mosques to offer namaz though there were customs and procedures in Islam regulating the manner of how can they offer prayer.When senior advocate M R Shamshad argued that the custom of providing separate space for Muslim women to offer namaz could not be questioned by a court and said though there was no ban on Muslim women offering namaz in a mosque, it was preferable that they did so in their homes. Justice Amanullah said, “A reason for Islam to prefer women offering namaz at home is that if every adult of a family goes to a mosque to offer namaz, who will take care of the children?”Taking the opportunity of the debate over faith vs fundamental rights arising from the Sabarimala temple entry case, Shamshad said the nine-judge bench must overrule the 1994 SC judgment in Ismail Farooqui case, relating to Ram Janmaboomi case, which had ruled that mosque is not essential for namaz.”Masjid is the essence of Islam, the core belief of Muslims. All religious practices are related to masjid. But in Ismail Farooqui, the SC illogically ruled that since namaz can be offered in an open ground, a mosque is not essential for namaz,” Shamshad argued..
