NEW DELHI: A countrywide crackdown has begun to dismantle an international drug syndicate operating from India, with ED carrying out searches across 20 locations on Tuesday in Mumbai, Surat, Ankleshwar and Rajkot, including premises linked to some associates of fugitive underworld don Dawood Ibrahim.Salim Dola, one of Dawood’s associates, was recently arrested in Turkey on India’s request and deported. Naveen Jindal NEW DELHI: A Delhi court Monday took cognisance of charges filed against industrialist Naveen Jindal, former coal secretary P C Parekh and others under IPC provisions relating to criminal conspiracy and cheating, and the Prevention of Corruption Act, in what it described as “one of the most voluminous chargesheets of coal block cases”.Special judge Sunena Sharma issued summons to Naveen Jindal, JSPL, Parekh, Rakesh Kumar Jindal, Ram Kishore, S K Agarwal and Jindal Strips Ltd (now Nalwa Sons Investments Ltd), directing them to appear before the court on July 17.According to CBI, Jindal Strips Ltd was allotted the Gare Palma IV/1 coal block in Chhattisgarh in 1996 for a sponge iron plant with a capacity of 0.6 MT per annum, despite the block containing substantially higher coal reserves. The approved mining lease area was fixed at 705 hectares, but the lease was allegedly executed beyond the area approved by Centre. NEW DELHI: CJI Surya Kant on Tuesday administered oath to five new Supreme Court judges — Justices Sheel Nagu, Sree Chandrashekhar, Sanjeev Sachdeva, Arun Palli and V S Mohana — taking the working strength of SC judges to a record 37 with one vacancy.The entire process — involving the recommendation of names by the five-member CJI-led collegium, vetting of names by govt and issuance of warrants of appointment by the President — was completed within a week. The collegium recommended the names on May 27, warrants of appointment were issued on June 1 after govt cleared them, and the new judges took oath on Tuesday.Justice Nagu became a judge of Madhya Pradesh HC in May 2011 and was appointed chief justice of Punjab and Haryana HC on July 9, 2024. As an SC judge, he would have a three-and-a-half-year tenure. Justice Nagu was part of the in-house committee panel inquiring into the discovery of partially burnt notes from the residence of then Delhi HC judge Yashwant Varma in March last year.Bombay HC CJ Chandrashekhar, who had become a judge of his parent HC in Jharkhand in Jan 2013, will have a tenure of less than four years in SC. He was part of the Lok Sabha speaker-appointed committee inquiring into the alleged misconduct of Justice Varma.MP HC CJ Sachdeva, who had become a judge of Delhi HC in April 2013, will have a tenure of three and a half years. J&K and Ladakh HC CJ Palli, appointed a judge in his parent Punjab and Haryana HC in Dec 2013, will have a tenure of three years and four months as SC judge. Justice Mohana is a first-generation lawyer and became an advocate on record in 1996. Designated as a senior advocate in April 2015, she will have a tenure of five years in SC.SC started its journey on Jan 26, 1950, with eight judges, including CJI Harilal Jekisondas Kania. NEW DELHI: Supreme Court has held that criminal proceedings should not be allowed to go on against a loan defaulter if the bank and the debtor reached a compromise for settlement of the loan account. It allowed the plea of a businessman who sought quashing of criminal case on the ground that he and the bank already compromised before debts recovery tribunal and paid the settlement amount of Rs 4.25 crore against the outstanding due of Rs 6.49 crore which included a notional interest of Rs 3.09 crore.“Having regard to the fact that the dispute between the parties arising out of banking transactions which are commercial transactions having overwhelmingly or predominantly civil flavour had ended in a compromise settlement, that too, in the manner which we have delineated above, in our view, the possibility of his conviction of appellant No. 1 (businessman) is remote and bleak. Therefore, continuation of the criminal case would cause grave prejudice and injustice to the appellants,” the bench said.In this case the bank had lodged criminal complaint of cheating and fraud against the borrower two years after settling the loan with him. The case was probed by CBI which filed chargesheet and it was alleged that businessman had used forged copies of audit report to get enhancement of cash credit limit more than two times of the original amount. Quashing the case, the court said such conduct of the bank betrays lack of good faith.“There is one more reason why we say so. If the respondent-Bank is permitted to go ahead with the criminal prosecution initiated after settlement of the loan account before the DRT, it would adversely impact the sanctity of such settlement which has become part of the judicial proceeding and which had the approval of a judicial forum like the DRT. NEW DELHI: Supreme Court has held that criminal proceedings should not be allowed to go on against a loan defaulter if the bank and the debtor reached a compromise for settlement of the loan account. NEW DELHI: The Indian govt has strongly rejected the reference to J&K in an EU-Pakistan joint statement, issued during EU foreign policy chief Kaja Kallas’s visit to Islamabad this week, saying those who have no locus standi on such matters should desist from making any comment on them.According to the joint statement, Pakistan and the EU briefed each other on J&K and Russia’s war against Ukraine, respectively, expressing support for peaceful resolution of conflicts through dialogue and diplomacy, in accordance with principles of the UN Charter.“We categorically reject such unwarranted references in the joint press communique on matters internal to India. The UTs of J&K and Ladakh are integral and inalienable parts of India,” said MEA spokesperson Randhir Jaiswal.Kallas’s visit to Pakistan took place amid Islamabad’s ongoing efforts to play the peacemaker in the US-Iran conflict and also India’s own efforts to scale up ties with Brussels in past few years that culminated in India-EU free trade agreement.
