The apex court has issued notice to the Centre for its response NEW DELHI: Observing that there are “enormous issues” with the working of 10th Schedule, Supreme Court Monday agreed to hear senior advocate Kapil Sibal’s plea for interpretation of anti-defection law in order to curb illegal defections through the route of political party merger.Though a bench of Justices P S Narasimha and Alok Aradhe said the issue ought to be raised in Parliament, it agreed to examine the matter after Sibal submitted that it would not be addressed in Parliament as it benefits those in power. The court then issued notice to Centre seeking its response.”These are issues typically to be raised before the floor of the House; if not, then at least before political parties. The 10th Schedule is intended to regulate the mechanism between the legislators… We have been seeing it. There are enormous issues with the 10th Schedule. But who made it? It’s the making of the MPs,” bench said.At the outset, Sibal submitted that the issue raised by his petition is very important and could have huge repercussions for the country’s polity. “Electoral verdict can be changed through this process. A majority can become a minority, and a minority can become a majority,” he said.Sibal has personally entered the legal battlefield by petitioning Supreme Court on the working of anti-defection law and said the interpretation of 10th Schedule’s fourth paragraph (which permits mergers) is the need of the hour. Sibal cited many instances of defection and subsequent merger of rebel MLAs and MPs with another party, including those affecting Sena UBT and TMC after the West Bengal elections.Sena UBT has also moved a petition questioning the Lok Sabha Speaker’s decision to allow the merger of six of its nine MPs with rival Sena party led by Eknath Shinde. Entertaining the petition last week, the apex court sought responses from Centre and Lok Sabha Secretariat.The fourth paragraph of 10th Schedule carves out an exception to disqualification for defections. It provides that members of a House would not be disqualified if their parent party merges with another, or objects to such merger and prefers to function as a separate group. IBC is to facilitate the resolution process and not to eclipse the statutory remedies NEW DELHI: Promoters of real estate companies use pending insolvency proceedings as a shield to protect themselves in court cases filed by homebuyers for not giving possession of flats, but Supreme Court on Monday clarified that a moratorium against the corporate debtor does not give protection to promoters and directors, and proceedings can continue against them.A bench of Justices Vikram Nath and Sandeep Mehta quashed an order passed by the National Consumer Disputes Redressal Commission by which a consumer complaint against promoters and directors of a Bengaluru-based real estate company was stayed in view of insolvency proceedings against the company. The court allowed the plea of homebuyers who challenged the NCDRC order.Moratorium to preserve assets of corporate for resolution: Supreme CourtSection 14 of Insolvency and Bankruptcy Code provides that once insolvency process begins and a moratorium is declared, the continuation of pending suits and proceedings against the corporate debtor, including execution proceedings, comes to an automatic halt. The object of this moratorium is to preserve the assets of the corporate debtor during the insolvency resolution proceedings and to facilitate an orderly resolution.Explaining the provision, the bench said it was not open either to the adjudicating authority or the court to enlarge its ambit beyond what the statute contemplated, and a plain reading of the provision made it clear that the moratorium operated against the corporate debtor alone.“No other category, whether it be any subsidiary company, any managers/directors, personal guarantors etc, can be added to it unless specifically provided,” it said.Homebuyers had moved SC through advocate Chandrachur Bhattacharya, contending that promoters of the company could not claim protection of the moratorium. Accepting their plea, the court said the protective sweep of a moratorium must remain within the four walls as carved out by the statute.“It ought not be expanded in a manner that stultifies remedies envisaged under the Consumer Protection Act, unless expressly provided. Code is to facilitate the resolution process and not to eclipse the statutory remedies,” the bench said while reviving the proceedings against promoters of Mantri Technology Constellation Pvt Ltd.“In the present case, respondent no. 1 (company) alone is the corporate debtor against whom the CIRP has been initiated. No independent moratorium or independent protection operates in favour of respondent nos. 2 to 7 (promoters and directors). In the absence of any legal bar against continuation of proceedings qua the said respondents, NCDRC was not justified in rejecting appellants’ prayer to proceed with the complaint against the rest of the respondents,” the bench said.Get the latest India News and Live updates. Unacceptable and must be avoided: MEA NEW DELHI: India summoned the Ukrainian ambassador Monday to condemn attacks on commercial shipping, underscoring the adverse impact of such attacks on the safety of maritime navigation, freedom of navigation and international commerce.However, Ukraine claimed it had warned India about the growing threats to civilian navigation from Russia’s actions in Black Sea, saying the only sustainable way to restore maritime security was to increase international pressure on Russia to end its attacks on civilian shipping. In a statement, the Ukrainian embassy here also sought dialogue between the foreign ministers on the Black Sea security situation.Ukrainian ambassador Oleksandr Polishchuk was summoned by the MEA in connection with the attack on the commercial vessel MV Omorfi that resulted in the death of an Indian national. The ministry said it conveyed its serious concern over the incident and condemned such attacks on commercial shipping in the strongest terms.”The ambassador was requested to convey to the Ukrainian authorities India’s strong concerns over the targeting of commercial vessels and reiterated that such actions, which endanger the lives of innocent civilian seafarers, are unacceptable and must be avoided,” the ministry said.The attacks by both Russian and Ukrainian forces on commercial shipping have caused the deaths of five Indian seafarers. In the latest such attack, a merchant vessel carrying four Indians was struck at Ukraine’s port of Odesa. While two Indian crew members were confirmed safe, information about the other two is awaited.Ukrainian embassy here said in a statement that foreign minister Andrii Sybiha had written to his counterpart S Jaishankar expressing sympathy for the families of Indian seafarers who lost their lives as a result of the deteriorating security situation in the Black Sea.”We hope that, following the relevant proposal made by the minister of foreign affairs of Ukraine, a conversation between the foreign ministers of our two countries will take place in the nearest future to discuss in detail the current security situation in the Black Sea region,” the Ukraine statement said.According to the embassy, Ukraine had consistently warned its international partners, including senior Indian officials, about the growing threats to civilian navigation arising from Russia’s actions in the Black Sea.”Ukraine has also informed its partners about the measures it is taking to prevent the delivery of military cargo and disrupt logistical routes used to sustain Russia’s war of aggression against Ukraine,” it said.The embassy also said that timely and preventive action by competent authorities was vital to protecting seafarers, ensuring the safety of civilian navigation, and strengthening international maritime security in regions where such threats were clearly identified.Get the latest India News and Live updates. Sources said a breakthrough emerged following LS Speaker Om Birla’s outreach to both the government and the opposition to break the impasse NEW DELHI: On a day the opposition’s protest over Delhi Police’s alleged excesses against protesting students washed out proceedings in both Houses of Parliament yet again, signs emerged that normalcy may return from Tuesday, with government’s bill for enhancing punishment in cases of paper leaks likely to be taken up for discussion in the lower House.Sources said a breakthrough emerged following Lok Sabha Speaker Om Birla’s outreach to both government and the opposition for breaking the impasse that has persisted since the monsoon session began on July 20, and that a discussion on the Vande Mataram bill, which makes insulting the national song a penal offence, may begin in Rajya Sabha.What also seems to have nudged the opposition to allow a discussion on Public Examinations (Prevention of Unfair Means) Amendment Bill, which was introduced by Union minister Jitendra Singh amid din, was government’s determination to push through its passage with a voice vote without a debate.It has also brightened the prospect of government revisiting its move to amend the women’s reservation law and increase seats in LS and state assemblies through a constitution amendment bill provided its hectic efforts to reach two-third majority in Parliament succeed.With government determined to secure passage of the public exams bill, Congress and its allies ran the risk of losing a chance to articulate their criticism, while BJP-led NDA would have used the opportunity to back its claim that leader of the opposition Rahul Gandhi and other opposition functionaries were running away from a debate.The bill is part of a raft of measures announced by PM Modi to pacify students protesting the NEET-UG paper leak and related issues, and Birla repeatedly emphasised the salience of discussion as the matter was linked to youth and the public exam process. Around 2pm, he told both opposition and government to sort out their differences before the House met again at 5pm.Sources said he met Congress’s K C Venugopal and Samajwadi Party’s Akhilesh Yadav, and also reached out to other opposition members, nudging them to agree to a debate.While six hours have been allotted for discussion, the time may be extended if the House wanted, he said, urging the opposition to choose discussion over the disruption it was causing by demanding a response from home minister Amit Shah over allegations of police excesses.Parliamentary affairs minister Kiren Rijiju noted that 91 amendment notices to the bill had been moved by opposition MPs and this suggested their willingness to join the discussion.Even as the two sides inched towards a resolution, they continued to trade charges in LS, with opposition insisting that Shah respond to the charge that police used excessive force, including pellet guns in Delhi, and AK-47 in Bihar, against protesting students. Opposition said Shah needed to come out of hiding and face Parliament.Govt, however, matched the aggression and accused Congress of being obstructive for partisan reasons. “The image of Congress has fallen.
