Justice RS Sodhi of Delhi high court had quashed all charges against the Hinduja brothers and AB Bofors, holding that the prosecution failed to provide admissible, reliable evidence NEW DELHI: The Supreme Court has dismissed an appeal challenging a 2005 Delhi HC judgement that had quashed criminal proceedings in the Bofors pay-off case, bringing to an end a four-decade-old politically sensitive case.A bench of Justices JB Pardiwala and K Vinod Chandran rejected the appeal filed by advocate Ajay K Agrawal, who pleaded for adjournment of the hearing.During the brief hearing, Agrawal requested four weeks to delete the names of parties who have died during the pendency of the case – Srichand P Hinduja and Gopichand P Hinduja. Prakash P Hinduja, who is the Europe chairman of the Hinduja Group, remains a respondent in the case. SC, however, refused to grant any further time to prolong the 2018 matter. “No question of adjournment. Minister of state for parliamentary affairs L Murugan informed the Rajya Sabha on Friday that the bill will be introduced in the Lok Sabha. NEW DELHIL: The Cabinet on Thursday approved the Tribunals Reforms Bill that will have the provision for setting up a National Tribunal Commission (NTC), which has been visualised as an independent body to supervise appointments and functioning of around 16 tribunals and look after their administrative and infrastructural needs.Minister of state for parliamentary affairs L Murugan informed the Rajya Sabha on Friday that the bill will be introduced in the Lok Sabha. TOI has learnt that NTC will be headed by a retired SC or high court judge for five years or till he or she turns 70 years.People aware of the proposal said the government has proposed the body at the instance of the Supreme Court.The apex court had ordered the constitution of NTC first in May 2018. It reiterated its directive in 2020. With Nitish Kumar stepping down as CM on April 15, the council of ministers was dissolved; Samrat Choudhary’s council, constituted on May 7, included Prakash NEW DELHI: The Supreme Court on Friday sought records from the Bihar government relating to the appointment of Deepak Prakash, who was not a member of the assembly, as a minister in Nov last year, his re-induction into the cabinet in May and his recent hurried nomination as an MLC allegedly to skirt around the six-month deadline within which such a minister must get elected to the House.A PIL has challenged his continuance as minister after the expiry of the six-month deadline within which a person, who is not a member of the assembly or legislative council, must get elected as a member of either house.Solicitor general Tushar Mehta, for the Bihar government, told a bench of Chief Justice Surya Kant, Justices Joymalya Bagchi, and V Mohana that the minister has since been nominated as an MLC by the governor; hence, his continuance was not unconstitutional.However, the petitioner, relying on the SC’s 2001 judgment in the SR Chaudhari case, which had categorically stated that the six-month deadline was non-negotiable, said the six-month deadline expired on May 20. With Nitish Kumar stepping down as CM on April 15, the council of ministers was dissolved. The new council of ministers was constituted under Samrat Choudhary on May 7, which included Prakash.
