Photo credit: X/ @FitRaheIndia New Delhi: Minor procedural lapses by hospitals and clinics will now attract administrative penalties instead of criminal fines under amendments to the Clinical Establishments (Registration and Regulation) Act, 2010 notified by the Union health ministry, as the Centre pushes ahead with its Jan Vishwas reforms to promote trust-based regulation.The amendments, notified on June 22, implement provisions of the Jan Vishwas (Amendment of Provisions) Act, 2026 and are aimed at reducing compliance burden, improving ease of doing business and ensuring proportionate regulatory enforcement, while continuing to safeguard patient safety and the quality of healthcare services.The changes apply to routine and low-risk procedures and minor administrative lapses, including surgeries for minor injuries, wound cleaning and stitching, mole removal, drainage of small abscesses, and minor reconstructive procedures of the eyelid, ear and nose, provided they do not pose an immediate risk to patients.Under the amended framework, the term “fine” has been replaced with “penalty” in Sections 40, 43 and 46 of the Act, shifting enforcement from criminal action to administrative adjudication. Section 44 has also been amended to introduce graded penalties for contraventions by companies, with the quantum of penalty linked to the nature and severity of the violation.The notification strengthens the adjudicating authority mechanism under Section 41 by expanding its scope to cover proceedings under Sections 40, 43 and 44. It also introduces a structured adjudication process that provides an opportunity for hearing before penalties are imposed, along with provisions for recovery of penalties and an appeal mechanism for aggrieved parties.The ministry said the changes are expected to encourage voluntary compliance, reduce unnecessary litigation and ensure proportionate action in cases of minor procedural non-compliances while maintaining regulatory oversight over clinical establishments.The amendments are part of the broader Jan Vishwas reform programme, which rationalises provisions across 79 Central Acts administered by 23 ministries and departments. IVF media are specialised laboratory solutions used to handle, preserve and grow eggs, sperm and embryos during fertility treatment.These products are regulated as medical devices under the Medical Devices Rules, 2017, and require licences for manufacture or import, CDSCO said. It added that assisted reproductive technology clinics and sperm banks are regulated under the Assisted Reproductive Technology (Regulation) Act, 2021 and the Surrogacy (Regulation) Act, 2021 to ensure safe and ethical reproductive healthcare practices.CDSCO has directed all stakeholders to ensure that IVF media, cryopreservation media, reagents and related consumables are supplied only to clinics and banks registered under the two Acts. The circular, issued in public interest, has been circulated to all state and Union Territory licensing authorities, CDSCO’s zonal and sub-zonal offices, manufacturers, importers and other stakeholders for compliance.Get the latest India news and live updates. Time for full investigation & accountability!” , Raut wrote.Raut targets BJP over donation controversyThe latest remarks come a day after Raut launched a sharp attack on the Bharatiya Janata Party, Prime Minister Narendra Modi and Union home minister Amit Shah over the Ram Mandir donation controversy, alleging that “no action” would be taken against those he described as being linked to the alleged scam.His demand also comes amid an ongoing investigation into alleged embezzlement of donations received at the Ayodhya temple.An FIR was registered on Thursday in connection with the alleged embezzlement of temple donations under multiple provisions of the Bharatiya Nyaya Sanhita (BNS), including Sections 306, 316(5), 317(4), 317(5), 61 and 3(5), following directions from the Uttar Pradesh government.The FIR named Anukalp Mishra, Lavkush Mishra, Avinash Shukla, Tinnu Yadav, Manish Yadav and others.The case was registered after former Samajwadi Party MLA Pawan Pandey alleged that between Rs 7 crore and Rs 7.5 crore in donations had been misappropriated from the Ram Mandir. Following the allegations, the Uttar Pradesh government constituted a three-member Special Investigation Team (SIT) on June 14 after a request from the Shri Ram Janmabhoomi Mandir Trust.Meanwhile, eight people named in the FIR have been arrested. Raut claimed that Shiv Sena (UBT) chief Uddhav Thackeray had donated Rs 1 crore along with the silver brick during the temple construction process NEW DELHI: Shiv Sena (UBT) MP Sanjay Raut on Friday questioned the alleged disappearance of a 4-kg silver brick donated by the party for the construction of the Ram Mandir in Ayodhya, demanding a detailed investigation and accountability from the Shri Ram Janmabhoomi Teerth Kshetra Trust.In a post on X, Raut claimed that Shiv Sena (UBT) chief Uddhav Thackeray had donated Rs 1 crore along with the silver brick during the temple construction process in the presence of thousands of party workers and saints, but alleged that there had been no acknowledgement from the trust regarding the offering.”Serious questions over the missing 4 kg silver brick donated by Shiv Sena for the Ram Mandir construction in Ayodhya. Time for full investigation & accountability!” , Raut wrote.Raut targets BJP over donation controversyThe latest remarks come a day after Raut launched a sharp attack on the Bharatiya Janata Party, Prime Minister Narendra Modi and Union home minister Amit Shah over the Ram Mandir donation controversy, alleging that “no action” would be taken against those he described as being linked to the alleged scam.His demand also comes amid an ongoing investigation into alleged embezzlement of donations received at the Ayodhya temple.An FIR was registered on Thursday in connection with the alleged embezzlement of temple donations under multiple provisions of the Bharatiya Nyaya Sanhita (BNS), including Sections 306, 316(5), 317(4), 317(5), 61 and 3(5), following directions from the Uttar Pradesh government.The FIR named Anukalp Mishra, Lavkush Mishra, Avinash Shukla, Tinnu Yadav, Manish Yadav and others.The case was registered after former Samajwadi Party MLA Pawan Pandey alleged that between Rs 7 crore and Rs 7.5 crore in donations had been misappropriated from the Ram Mandir. Following the allegations, the Uttar Pradesh government constituted a three-member Special Investigation Team (SIT) on June 14 after a request from the Shri Ram Janmabhoomi Mandir Trust.Meanwhile, eight people named in the FIR have been arrested. The complaint was lodged by Krishna Mohan, a member of the Shri Ram Janmabhoomi Teerth Kshetra Trust, based on recommendations in the SIT’s preliminary report.Senior officials cited by news agency PTI said that all eight accused, who were associated with counting cash and valuables received as temple donations, were arrested in Ayodhya late Thursday night and are being questioned.Police are preparing to produce them before a magistrate as the investigation continues.Get the latest India news and live updates.
