NEW DELHI: What is being informally followed in recent months in SC has now become official. Senior advocates have been barred from mentioning any case before any bench. The court has issued a circular prescribing procedure for mentioning, adjournment and listing of urgent cases.It says all fresh cases relating to bail/cancellation of bail, death penalty, habeas corpus, eviction, demolition or any other matter involving urgent interim relief will be listed within next two working days. Officials maintain that the push remains culturally anchored and aimed at strengthening India’s linguistic traditions.KTS 4.0 will open at NaMo Ghat on Dec 2, coinciding with Karthigai Deepam on Dec 4. More than 1,500 delegates from Tamil Nadu will participate in an eight-day programme featuring knowledge-sharing sessions, cultural events and heritage visits to Kashi Vishwanath temple, BHU, Sarnath, Hanuman Ghat and Ayodhya temple. The theme – “Let Us Learn Tamil or Tamil Karkalam” – reinforces the idea of Indian languages as part of a shared civilisational fabric.What makes this year’s edition notable is the Centre’s scaling-up of Tamil-learning programmes at a time when its relationship with Tamil Nadu govt remains strained over NEET, the three-language policy and centralisation of education regulation. Central agencies are scrutinizing the Insolvency and Bankruptcy Code (IBC) process for alleged rigging and misuse. The ED arrested Amit Katyal, Lalu Prasad Yadav’s aide, in a real estate fraud case involving undervalued land sales and bid manipulation. Investigations reveal collusion between bank officials, resolution professionals, and buyers, leading to significant financial irregularities. The probe revealed collusion of an official of a bank with people associated with the insolvency process by agreeing to sale of land at much undervalued prices NEW DELHI: Misuse of Insolvency and Bankruptcy Code (IBC) process and alleged rigging of bids before National Company Law Tribunal (NCLT) have come under the scanner of central agencies. ED recently arrested Amit Katyal, a close aide of former railway minister Lalu Prasad Yadav in one such case, and conducted searches on a lawyer associated with NCLT in another case related to sale of undervalued land through “misuse of IBC”. ED had carried out searches on Nov 20 at six places in Delhi and Gurgaon on middlemen who were part of the insolvency process – resolution professionals, NCLT advocate and buyer of the undervalued property in question, RDB Infrastructure & Power Ltd. The agency claimed it had seized crucial evidence of bid rigging and unexplained cash of Rs 50 lakh.”Digital data recovered from their mobile phones contained draft invoices reflecting proposed illicit and unaccounted consideration, indicating arrangements for illegal gains outside the IBC/NCLT framework and without such approval process of creditors or homebuyers,” ED said. The case was related to Universal BuildWell and its promoters for non-completion of real estate projects and for cheating homebuyers.The agency further said “evidence collected during the search revealed manipulation of the bidding process through predetermined and artificially suppressed bids, including one bid submitted by the middleman advocate himself, indicating clear collusion and bid rigging”.The probe revealed collusion of an official of a private bank – a secured creditor which had agreed to a huge haircut for its losses despite significant appreciation in land value – with people associated with the insolvency process by agreeing to sale of land at much undervalued prices. Homebuyers were kept uninformed even by the resolution professional.Lalu’s aide Amit Katyal, by now one of the most regular visitors to ED headquarters because of the multiple cases he is facing, was arrested on Nov 17 in a case of real estate fraud involving Angle Infrastructure Pvt Ltd, where he is accused of non-delivery of flats in a project named Krrish Florence Estate in Sector 70 of Gurgaon on 14 acres of land.”Investigation revealed fraudulent bookings by Katyal to third parties in a project meant for central government employees, and diversion of funds. He alienated a part of the licensed land of 2 acres valuing Rs 130 crore at undervalued rates to a third party during the insolvency proceedings in a clear abuse of the process of law under IBC,” ED said.He is also accused of laundering funds received as loans from several other banks and has FIRs registered against him by the Gurugram police. Central agencies are scrutinizing the Insolvency and Bankruptcy Code (IBC) process for alleged rigging and misuse. The ED arrested Amit Katyal, Lalu Prasad Yadav’s aide, in a real estate fraud case involving undervalued land sales and bid manipulation. Investigations reveal collusion between bank officials, resolution professionals, and buyers, leading to significant financial irregularities. The probe revealed collusion of an official of a bank with people associated with the insolvency process by agreeing to sale of land at much undervalued prices NEW DELHI: Misuse of Insolvency and Bankruptcy Code (IBC) process and alleged rigging of bids before National Company Law Tribunal (NCLT) have come under the scanner of central agencies. ED recently arrested Amit Katyal, a close aide of former railway minister Lalu Prasad Yadav in one such case, and conducted searches on a lawyer associated with NCLT in another case related to sale of undervalued land through “misuse of IBC”. ED had carried out searches on Nov 20 at six places in Delhi and Gurgaon on middlemen who were part of the insolvency process – resolution professionals, NCLT advocate and buyer of the undervalued property in question, RDB Infrastructure & Power Ltd. The agency claimed it had seized crucial evidence of bid rigging and unexplained cash of Rs 50 lakh.”Digital data recovered from their mobile phones contained draft invoices reflecting proposed illicit and unaccounted consideration, indicating arrangements for illegal gains outside the IBC/NCLT framework and without such approval process of creditors or homebuyers,” ED said. The case was related to Universal BuildWell and its promoters for non-completion of real estate projects and for cheating homebuyers.The agency further said “evidence collected during the search revealed manipulation of the bidding process through predetermined and artificially suppressed bids, including one bid submitted by the middleman advocate himself, indicating clear collusion and bid rigging”.The probe revealed collusion of an official of a private bank – a secured creditor which had agreed to a huge haircut for its losses despite significant appreciation in land value – with people associated with the insolvency process by agreeing to sale of land at much undervalued prices. Homebuyers were kept uninformed even by the resolution professional.Lalu’s aide Amit Katyal, by now one of the most regular visitors to ED headquarters because of the multiple cases he is facing, was arrested on Nov 17 in a case of real estate fraud involving Angle Infrastructure Pvt Ltd, where he is accused of non-delivery of flats in a project named Krrish Florence Estate in Sector 70 of Gurgaon on 14 acres of land.”Investigation revealed fraudulent bookings by Katyal to third parties in a project meant for central government employees, and diversion of funds. He alienated a part of the licensed land of 2 acres valuing Rs 130 crore at undervalued rates to a third party during the insolvency proceedings in a clear abuse of the process of law under IBC,” ED said.He is also accused of laundering funds received as loans from several other banks and has FIRs registered against him by the Gurugram police. NEW DELHI/BHOPAL: Maulana Mahmood Madani, head of Jamiat-Ulama-Hind, Saturday accused Supreme Court and govt of undermining minority rights and said that recent court verdicts, including those in the Babri Masjid and triple talaq cases, suggested that the judiciary was functioning “under govt pressure”.”Supreme Court is entitled to be called ‘supreme’ only as long as it upholds the Constitution and the rights enshrined in law; otherwise, it loses moral legitimacy,” Madani said, drawing a sharp response from the BJP which accused him of making inflammatory remarks and pushing the country towards division.Madani, who was addressing a meeting of the national governing body of the influential body of Deobandi critics, also justified the concept of Jihad as a “noble duty” aimed at “eliminating injustice, protecting humanity and establishing peace” and asserted that “wherever oppression takes place, there will be jihad”.Alleging that “anti-Islam forces” have distorted the concept of jihad, turning it into a term synonymous with violence, to malign Muslims, he said armed struggle is sanctioned only to prevent oppression and disorder and that “jihad is not an individual or private undertaking. Only a legitimate and organised state authority can determine it under Islamic jurisprudence.”He added, “India, being a democratic and secular nation, is not an Islamic state; hence any debate about physical jihad here has no relevance. Muslims are constitutionally bound citizens, and govt is responsible for protecting the rights of all.”Madani also reiterated Muslims’ opposition to the singing of national song Vande Mataram. BJP’s response was swift and furious. “‘Whenever there is oppression, jihad will be waged’ is an extremely inappropriate remark as terror and violence have been inflicted not only on India but across the world in the name of jihad,” said party spokesperson Sambit Patra.”His statement that Supreme Court has no right to call itself supreme is extremely unfortunate and completely unacceptable,” the BJP spokesperson further said, adding the apex court can take suo motu cognizance of his comments.On Madani’s stand against Vande Mataram, Patra said that such a mindset hurts the country’s unity and constitutional values. “He should remember that Vande Mataram is not a symbol of any religion but the fragrance of India’s soil and the voice of its soul. Jamiat-Ulama-Hind chief Maulana Mahmood Madani accused the Supreme Court and government of undermining minority rights, suggesting judicial verdicts are made under government pressure. He also defended Jihad as a noble duty against injustice, while the BJP condemned his remarks as inflammatory and divisive, particularly his opposition to Vande Mataram. NEW DELHI/BHOPAL: Maulana Mahmood Madani, head of Jamiat-Ulama-Hind, Saturday accused Supreme Court and govt of undermining minority rights and said that recent court verdicts, including those in the Babri Masjid and triple talaq cases, suggested that the judiciary was functioning “under govt pressure”.”Supreme Court is entitled to be called ‘supreme’ only as long as it upholds the Constitution and the rights enshrined in law; otherwise, it loses moral legitimacy,” Madani said, drawing a sharp response from the BJP which accused him of making inflammatory remarks and pushing the country towards division.Madani, who was addressing a meeting of the national governing body of the influential body of Deobandi critics, also justified the concept of Jihad as a “noble duty” aimed at “eliminating injustice, protecting humanity and establishing peace” and asserted that “wherever oppression takes place, there will be jihad”.Alleging that “anti-Islam forces” have distorted the concept of jihad, turning it into a term synonymous with violence, to malign Muslims, he said armed struggle is sanctioned only to prevent oppression and disorder and that “jihad is not an individual or private undertaking. Only a legitimate and organised state authority can determine it under Islamic jurisprudence.”He added, “India, being a democratic and secular nation, is not an Islamic state; hence any debate about physical jihad here has no relevance. Muslims are constitutionally bound citizens, and govt is responsible for protecting the rights of all.”Madani also reiterated Muslims’ opposition to the singing of national song Vande Mataram. BJP’s response was swift and furious. “‘Whenever there is oppression, jihad will be waged’ is an extremely inappropriate remark as terror and violence have been inflicted not only on India but across the world in the name of jihad,” said party spokesperson Sambit Patra.”His statement that Supreme Court has no right to call itself supreme is extremely unfortunate and completely unacceptable,” the BJP spokesperson further said, adding the apex court can take suo motu cognizance of his comments.On Madani’s stand against Vande Mataram, Patra said that such a mindset hurts the country’s unity and constitutional values. “He should remember that Vande Mataram is not a symbol of any religion but the fragrance of India’s soil and the voice of its soul. In the 150th year of Vande Mataram, Madani’s provocative comments expose his divisive agenda.”Govt has celebrated the anniversary of Vande Mataram with several events, with there being talk that it may seek a discussion on India’s national song in the upcoming session of Parliament.Madani’s remarks come close on the heels of his uncle Arshad, head of the rival faction of the Deobandi outfit, alleging that Muslims were being persecuted. Speaking in the immediate aftermath of the Red Fort blast and the arrest of the promoter of Al-Falah University, which has been under spotlight after the arrests of its doctors and employees in connection with the attack, Madani senior said Muslim institutions were facing persecution.
