TMC supremo Mamata Banerjee NEW DELHI: The ruling Trinamool Congress (TMC) on Friday moved Supreme Court against the Calcutta high court’s order rejecting the plea challenging deployment of only central government’s staff at couting centers on May 4.The Mamata Banerjee’s party had challenged the poll duty assigned to central government and PSU (Public Sector Undertaking) employees as supervisors in the vote counting.The high court told the TMC that appointing central or state officers as counting supervisors is the Election Commission’s prerogative. It said that if central officers are found to have manipulated counting and favoured the BJP, the party can file an election petition. Earlier, the court had asked why only central officers were being appointed, to which the EC replied that the same practice was followed in Kerala.Justice Krishna Rao, hearing the case, asked EC, “If there is an objection, can the Election Commission not adjudicate? Why are you not going for the state govt?” The HC also pointed out that the statute allows the ECI to appoint employees from either the state govt or central govt and employees of PSUs for the role.EC counsel Dama Seshadri Naidu replied, “We have done that in Kerala. We have not singled out any state. As the situation demands, we do that.”Senior advocate Kalyan Banerjee, appearing for the petitioner, questioned, “Do you disbelieve these state govt employees? You have conducted the entire election with state govt staff. Why are you adopting a discriminatory approach towards West Bengal? In all, 2,500 companies have been brought here. If even one company had been in Pahalgam, those 26 people would not have been killed.”Justice Rao in his order said, “Section 100 of the Representation of the People Act provides that any noncompliance with the provisions of the Constitution of this Act or of any rules or orders made under this Act shall be grounds for declaring election to be void and thus, if the petitioner finds that during the counting, the central govt employees who have been appointed as counting supervisor and counting assistants favoured the candi-date of the BJP due to which the candidate of the petitioner defeated, the petitioner has the liberty to challenge the same in an election petition.”The high court also said while dismissing the petition, “It is the prerogative of the office of the Election Commission of India to appoint the counting supervisor and counting assistant either from the state govt or the central govt. This court does not find any illegality for appointing counting supervisor and counting assistant from the central govt / central PSU employee instead of state govt employee.”The high court also said, “Only the counting supervisor and the counting assistants will not be in the counting room. Micro observers, counting agents of the candidates who are contesting the election and counting personnel will also be in the counting room. The Supreme Court has agreed to examine a plea seeking a ban on female genital mutilation (FGM) practiced within the Dawoodi Bohra Muslim community. The court issued a notice to the Centre and the Ministry of Law and Justice, acknowledging the NGO’s argument that FGM is not an essential part of Islam and violates children’s rights.  NEW DELHI: Supreme Court on Friday agreed to examine a plea to ban practice of female genital mutilation (FGM) or female circumcision prevailing in Muslims, specially Dawoodi Bohra Muslim community and issued notice to Centre and ministry of law and justice seeking their response.A bench of Justices B V Nagarathna & R Mahadevan issued notice on a PIL filed by NGO Chetna Welfare Society which alleged that the practice was not an essential part of Islam and it amounted to violation of rights of children who are forced to undergo FGM. Senior advocate Shashi Kiran and lawyer Sadhana Sandhu, appearing for the organisation told the court that various agencies including WHO, UN agencies and human-rights bodies have repeatedly called for states to prevent, criminalise and eliminate FGM as medical evidence showed that short-term and long-term physical and psychological harms are caused due to it.”It is further submitted that there is not any independent law specifically banning this. The act itself falls under multiple offences relating to causing hurt under BNS, such as sections 113, 118(1), 118(2), and 118(3). Even in Pocso Act, touching the genitalia of a minor for non-medical reasons is a violation. It is submitted that WHO has classified FGM as a gross violation of human rights of girls and women. It violates the fundamental guarantees provided by Universal Declaration of Human Rights. Furthermore, FGM is a serious health concern as it can cause infections, problems relating to childbirth, and other severe physical impairments. In Dec 2012, UNGA adopted a unanimous resolution which called for elimination of FGM,” the petition said.It said approximately 75% of women of the community put their daughters to the barbaric practice of FGM and pleaded the court to intervene to put to end the practice. The petitioner said several countires including US, UK, Australia, and several African countries have banned FGM but India does not have a specific law banning FGM. “Dawoodi Bohras are a religious denomination within Shia Islam. They are the most well-known Muslim community in India to practice FGC, known as Khatna in the community – a ritual that many Islamic scholars around the world do not endorse. The Supreme Court has agreed to examine a plea seeking a ban on female genital mutilation (FGM) practiced within the Dawoodi Bohra Muslim community. The court issued a notice to the Centre and the Ministry of Law and Justice, acknowledging the NGO’s argument that FGM is not an essential part of Islam and violates children’s rights. NEW DELHI: Supreme Court on Friday agreed to examine a plea to ban practice of female genital mutilation (FGM) or female circumcision prevailing in Muslims, specially Dawoodi Bohra Muslim community and issued notice to Centre and ministry of law and justice seeking their response.A bench of Justices B V Nagarathna & R Mahadevan issued notice on a PIL filed by NGO Chetna Welfare Society which alleged that the practice was not an essential part of Islam and it amounted to violation of rights of children who are forced to undergo FGM. Senior advocate Shashi Kiran and lawyer Sadhana Sandhu, appearing for the organisation told the court that various agencies including WHO, UN agencies and human-rights bodies have repeatedly called for states to prevent, criminalise and eliminate FGM as medical evidence showed that short-term and long-term physical and psychological harms are caused due to it.”It is further submitted that there is not any independent law specifically banning this. The act itself falls under multiple offences relating to causing hurt under BNS, such as sections 113, 118(1), 118(2), and 118(3). Even in Pocso Act, touching the genitalia of a minor for non-medical reasons is a violation. It is submitted that WHO has classified FGM as a gross violation of human rights of girls and women. It violates the fundamental guarantees provided by Universal Declaration of Human Rights. Furthermore, FGM is a serious health concern as it can cause infections, problems relating to childbirth, and other severe physical impairments. In Dec 2012, UNGA adopted a unanimous resolution which called for elimination of FGM,” the petition said.It said approximately 75% of women of the community put their daughters to the barbaric practice of FGM and pleaded the court to intervene to put to end the practice. The petitioner said several countires including US, UK, Australia, and several African countries have banned FGM but India does not have a specific law banning FGM. “Dawoodi Bohras are a religious denomination within Shia Islam. They are the most well-known Muslim community in India to practice FGC, known as Khatna in the community – a ritual that many Islamic scholars around the world do not endorse. NEW DELHI: Indian forces on Monday said they had eliminated seven terrorists in Jammu and Kashmir’s Kishtwar district after nearly a year of sustained joint operations in the high-altitude Chatroo belt. The operation, carried out by the White Knight Corps along with Jammu and Kashmir Police and the CRPF, followed months of tracking militants through dense forests and rugged mountainous terrain.Detailing the scale of the effort, the White Knight Corps said, “Relentless and painstaking high-altitude joint operations were conducted over 326 days in the Kishtwar region. Forces tracked terrorists in challenging conditions of cold, wet and freezing weather across daunting terrain, leading to multiple contacts.”According to the Corps, troops worked alongside Jammu and Kashmir Police and the CRPF, drawing on a “well-knit intelligence grid established by civil and military intelligence agencies,” and have “finally eliminated all seven dreaded terrorists in Chatroo, Kishtwar.” The Army said modern tools played a central role, adding, “Technology in the form of FPV drones, satellite imagery, RPAs/UAVs, communication etc was continuously leveraged to assist in operations.”Three members of the Pakistan-based Jaish-e-Mohammad were killed in an encounter in the forested foothills on Sunday. Officials said the militants opened fire from inside a mud house as search parties closed in. The structure caught fire during the gunfight, and the bodies recovered were charred beyond recognition.
