Supreme Court  NEW DELHI: SC Wednesday commenced hearing on the validity of the law for appointment of CEC, ECs by a panel of PM, a Union cabinet minister and LoP, while the apex court had in 2023 suggested that the committee comprise PM, LoP and CJI, even as it left the issue for Parliament to decide.Appearing before a bench of Justices Dipankar Datta and Satish Chandra Sharma, advocates Vijay Hansaria and Gopal Sankaranarayanan contended that SC’s 2023 verdict was meant to bring an end to the executive’s prerogative in appointments of chief election commissioner (CEC) and election commissioners (ECs) by appointing a panel consisting of the PM, the leader of opposition (LoP) and the CJI, but the law seeks to undo the verdict by restoring the Centre’s exclusivity in the decision-making process, as two out of three members are from govt.They emphasised that the independent authority must be manned by independent people and not by govt’s men. The advocates were referring to the CEC and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, which excludes the CJI from the appointment panel.The bench, however, said that the 2023 verdict pointed out that its order was to be followed till the law is framed and added how could the court now interfere after the law has been passed. The lawyers, however, contended that the ratio of the judgment cannot be undone by Parliament.Hansaria also submitted that the role of Election Commission has come under criticism and said it was unfortunate that slogan shouting was being done by political parties on a public platform. Though the court said that the remarks qualified as “contempt”, it had decided not to go ahead with the charges “due to its magnanimity.”The top court further questioned the BJP leader what “budgetary allocation” she had helped in getting for solving stray dogs problem.The Supreme Court, earlier this month, reviewed the stray dog issue in Delhi-NCR after a rise in dog bite cases. The judges said public safety must come first, especially in places like schools, hospitals, and railway stations. The court questioned who would be held responsible if a dog attacks someone and said that those who want to care for dogs should keep them as licensed pets rather than letting them roam freely.Last year, the SC had directed that stray dogs be removed from the premises of educational institutions, hospitals, and bus and railway stations, and ruled that they should not be returned to the same areas after sterilisation.Maneka had criticised this order saying: “This is as bad as or even worse than Justice Pardiwala’s judgement. This cannot be put into practice…If 5000 dogs are removed, where will you keep them? You need 50 shelters…But you do not have that. You need people to pick them up. What difference will removing 5000 dogs make? While we very proudly say that energy consumption per capita is low in India, we must understand that this is because of two reasons-lack of accessibility and affordability. If India is to develop, we must provide energy to all at affordable prices. With this vision, TERI launched Lighting a Billion Lives.”Dr Jeevan Kumar Jethani, Scientist-F and Senior Director, MNRE, averred, “Even after 76 years of Independence, if we are not able to provide light, it does not reflect well. The government has been tremendously working towards providing grid connections and extending services through solar energy where grid connection is not possible. It is our duty to provide energy for rural livelihoods so that people can carry out economic activities while remaining in their villages, without having to leave for urban areas in search of jobs.”Dr Amit Kumar Thakur, Head-CSR, TERI, said, “We began with lighting homes; we now move towards powering livelihoods. LaBL has a long canvas. Launched in 2008, we began this journey with a clear vision of providing electricity where the grid could not reach.
