. NEW DELHI: A Parsi woman Tuesday questioned a decision of the Valsad Parsi Panchayat barring women who married men of another faith from attending funeral rites of their parents, and challenged a Gujarat high court judgment that stated a woman’s religion is extinguished with marriage as she embraces the husband’s religion. Appearing for Goolrokh M Gupta, senior advocate Darius J Khambata told a nine-judge bench led by CJI Surya Kant that most Parsi Panchayats impose no restrictions on community women even if they marry outside Zoroastrian faith, but the Valsad Parsi Panchayat had imposed restrictions, which do not apply to Parsi men marrying women professing another religion. Khambata asked how the woman, who continued to practise Zoroastrianism for all purposes even after marrying a Hindu man under the Special Marriage Act, could be deprived of or discriminated against from entering the place of worship. Parsi Panchayat is an administrative body and not a religious denomination that can create practices not prescribed in religion, especially when they are not applicable to men from the community, he said. Shah ensured that protection was arranged at every such location,” a BJP functionary said. . Shah’s team also appointed a dedicated booth-level in-charge across every booth in Bhabanipur. Their job was twofold — to flag any internal rift within the party and to report any TMC intimidation on the ground. Shah’s personal target was to get all BJP workers to cast their votes before 11 am and then work to ensure maximum turnout for the party. BJP members, including MLAs from other states with whom different communities could relate, were also deployed. Through the SIR process, around 47,000 names were removed from the voter rolls in Bhabanipur — these were either deceased voters or duplicate entries that TMC alleged were exploited to cast bogus votes. NEW DELHI: A nine-judge Supreme Court bench led by CJI Surya Kant on Tuesday said the SC in 2006 should have outrightly “thrown in the dustbin’ the original PIL that led to quashing of Sabarimala Ayyappa Temple custom restricting entry of women in the 10 to 50 age group. “All India Young Lawyers Association’, which filed the PIL in 2006 through its president Naushad Ali, narrated through senior advocate RP Gupta how a misconduct by the thantri of Ayyappa temple led to filing of the petition challenging the restriction. The bench led by CJI Kant said SC at best could have ordered investigations into the misconduct to bring the guilty to the book. But based on newspaper reports, the PIL could not have been entertained, it said.The bench said, “SC had entertained the PIL based on ‘such documents’, which should have been thrown in the dustbin. Locus standi was generated based on newspaper reports. SC should have ensured that action against the offender is expedited and nothing more.” The nine-judge bench consists of CJI Kant, Justices B V Nagarathna, M M Sundresh, Ahsanuddin Amanullah, Aravind Kumar, Augustine G Masih, Prasanna B Varale, R Mahadevan and Joymalya Bagchi. Justice Kumar asked whether the lawyers’ body had passed a resolution for filing the PIL and whether it was a registered body. Gupta said there was no resolution and that though Naushad Ali was only a name-lender, threats were given to him as well as to his counsel. “Then CJI Dipak Misra, who was the architect of the controversial judgment, had offered security for the petitioner and its counsel. Then CJI Misra had said that even if the petitioner wanted to withdraw the PIL, the court would not allow it,” Gupta informed. CJI Kant observed, “So it was de facto a suo motu petition (taken up on its own by the court) de jure filed by the petitioner organisation?” The suggestion that the matter had been, in effect, engineered by the bench led by then CJI Misra found some confirmation in Justice Nagarathna’s remark: “This is a realistic assessment of the CJI (Kant).”Justice Nagarathna said, “The former CJI offered security to you and the petitioner organisation president. He could have ensured no security threat to you by not entertaining the petition. Why would a non-believer in Ayyappa question the temple customs carried on for decades based on faith and belief of devotees?” “Are you the chief priest of the country to question temple customs and say how can there be such a custom in Ayyappa temple at Sabarimala,” she said. Justice Sundresh said it appears to be a clear case of abuse of process of law. NEW DELHI: A nine-judge Supreme Court bench led by CJI Surya Kant on Tuesday said the SC in 2006 should have outrightly “thrown in the dustbin’ the original PIL that led to quashing of Sabarimala Ayyappa Temple custom restricting entry of women in the 10 to 50 age group. “All India Young Lawyers Association’, which filed the PIL in 2006 through its president Naushad Ali, narrated through senior advocate RP Gupta how a misconduct by the thantri of Ayyappa temple led to filing of the petition challenging the restriction. The bench led by CJI Kant said SC at best could have ordered investigations into the misconduct to bring the guilty to the book. But based on newspaper reports, the PIL could not have been entertained, it said.The bench said, “SC had entertained the PIL based on ‘such documents’, which should have been thrown in the dustbin. Locus standi was generated based on newspaper reports. SC should have ensured that action against the offender is expedited and nothing more.” The nine-judge bench consists of CJI Kant, Justices B V Nagarathna, M M Sundresh, Ahsanuddin Amanullah, Aravind Kumar, Augustine G Masih, Prasanna B Varale, R Mahadevan and Joymalya Bagchi. Justice Kumar asked whether the lawyers’ body had passed a resolution for filing the PIL and whether it was a registered body. Gupta said there was no resolution and that though Naushad Ali was only a name-lender, threats were given to him as well as to his counsel. “Then CJI Dipak Misra, who was the architect of the controversial judgment, had offered security for the petitioner and its counsel. Then CJI Misra had said that even if the petitioner wanted to withdraw the PIL, the court would not allow it,” Gupta informed. CJI Kant observed, “So it was de facto a suo motu petition (taken up on its own by the court) de jure filed by the petitioner organisation?” The suggestion that the matter had been, in effect, engineered by the bench led by then CJI Misra found some confirmation in Justice Nagarathna’s remark: “This is a realistic assessment of the CJI (Kant).”Justice Nagarathna said, “The former CJI offered security to you and the petitioner organisation president. He could have ensured no security threat to you by not entertaining the petition. Why would a non-believer in Ayyappa question the temple customs carried on for decades based on faith and belief of devotees?” “Are you the chief priest of the country to question temple customs and say how can there be such a custom in Ayyappa temple at Sabarimala,” she said. Justice Sundresh said it appears to be a clear case of abuse of process of law. . NEW DELHI: The Cabinet on Tuesday approved a proposal to raise the sanctioned strength of judges in the Supreme Court from the current 33 to 37, excluding the Chief Justice of India. With this, the effective strength of the apex court, including CJI, will rise from 34 to 38, reports Dipak Dash. I&B minister Ashwini Vaishnaw said that more than 92,000 cases are pending before the SC and the increase in the number of judges will help speed up justice. The judge strength of the apex court was last increased from 30 to 33 (excluding the Chief Justice of India) by amending the original Supreme Court (Number of Judges) Amendment Act, 2019. TOI has learnt that the SC had sought 10 more judges to take the total strength to 43, excluding the CJI.SC had sought 10 more judges, TOI has learnt. This number was arrived at after an assessment by a threejudge committee set up by the CJI. People aware of the development said at present, there are over 1,200 cases pending before three-judge bench, over 160 before five-judge bench, around three dozens before seven-judge bench and around 45 before nine-judge bench. The expansion would cost govt Rs 15 crore per annum which will be met from Consolidated Fund of India.
