NEW DELHI: Actor-turned-politician Vijay’s TVK has put the wheels in motion to form the government in Tamil Nadu, as it emerged as the single-largest party but fell short of crossing the majority mark by 10 seats.Reportedly, TVK is seeking backing from smaller parties such as Congress, PMK, Left parties, CPM, and VCK, which together could help the party cross the majority mark.TVK chief Vijay also sought time from Tamil Nadu Governor Rajendra Arlekar to meet him as part of the process for government formation.Here is what’s happening in Tamil Nadu:Congress jumps ship?News agency PTI, citing sources, reported that the Tamil Nadu Congress has decided to support the formation of a secular government in the state. The Union Territory sits astride the Western rivers and possesses enormous, largely untapped hydropower potential.Development of that potential is constrained at every turn by the Treaty’s design restrictions, Pakistan’s systematic objections, and the perpetual risk of a multi-tiered, long-drawn dispute resolution mechanism.Local populations have increasingly come to view the Treaty not as a framework for shared benefit but as an instrument of their own economic marginalisation — an external imposition that prevents them from developing the natural resources flowing through their own territory.2.3) Energy security implications: India’s inability to optimally develop the hydropower potential of the Western rivers has direct implications for national energy security.The Treaty’s restrictions mean that potential capacity — as a clean, renewable and economically efficient energy source — has been sacrificed purely because of Pakistan’s strategic obstruction of even the limited rights India possesses in this asymmetric agreement.3. India’s case: The Treaty was intended to achieve the “most complete and satisfactory utilisation of the waters of the Indus system of rivers” in a “spirit of goodwill and friendship” — a context that no longer exists.The treaties derive their legitimacy not merely from the force of law but from the good faith implementation of their terms by all signatories.Pakistan’s documented and persistent use of state-sponsored terrorism as an instrument of foreign policy against India — culminating in atrocities including the 2001 Parliament attack, the 2008 Mumbai attacks and most recently the Pahalgam attack of April 2025 — fundamentally challenges the premise upon which India’s continued compliance with the IWT rests.Bilateral agreements cannot be selectively honoured. A state cannot simultaneously breach the foundational norms of inter-state conduct while demanding that its negotiating partner fulfil treaty obligations that disproportionately benefit the norm-breaker.The Treaty cannot be an island of Indian compliance within a sea of Pakistani bad faith. India’s step represents an assertion long overdue — that international agreements are a two-way street.4. Conclusion: The Indus Waters Treaty has long been celebrated as a triumph of international diplomacy.This paper has argued that such a characterisation fundamentally misrepresents what actually occurred: a negotiation process in which Pakistani intransigence was rewarded with concessions, and Indian goodwill was systematically exploited to produce an agreement that was inequitable from its inception.Nevertheless, India surrendered 80 per cent of the water, paid £62 million (approximately .5 billion in present value) to facilitate that surrender, accepted one-sided operational restrictions on its own territory, and has maintained scrupulous compliance for sixty-five years –including through Pakistan inflicted multiple wars and sustained sponsoring of cross-border terrorism.In return, India has received a Treaty agreed to in good faith that Pakistan uses as a tool of developmental obstruction, a ‘water war’ narrative it deploys internationally with no factual basis, and the permanent underdevelopment of vast tracts of Indian territory.India’s step is to protect its legitimate interests in the Indus Basin. The Union Territory sits astride the Western rivers and possesses enormous, largely untapped hydropower potential.Development of that potential is constrained at every turn by the Treaty’s design restrictions, Pakistan’s systematic objections, and the perpetual risk of a multi-tiered, long-drawn dispute resolution mechanism.Local populations have increasingly come to view the Treaty not as a framework for shared benefit but as an instrument of their own economic marginalisation — an external imposition that prevents them from developing the natural resources flowing through their own territory.2.3) Energy security implications: India’s inability to optimally develop the hydropower potential of the Western rivers has direct implications for national energy security.The Treaty’s restrictions mean that potential capacity — as a clean, renewable and economically efficient energy source — has been sacrificed purely because of Pakistan’s strategic obstruction of even the limited rights India possesses in this asymmetric agreement.3. India’s case: The Treaty was intended to achieve the “most complete and satisfactory utilisation of the waters of the Indus system of rivers” in a “spirit of goodwill and friendship” — a context that no longer exists.The treaties derive their legitimacy not merely from the force of law but from the good faith implementation of their terms by all signatories.Pakistan’s documented and persistent use of state-sponsored terrorism as an instrument of foreign policy against India — culminating in atrocities including the 2001 Parliament attack, the 2008 Mumbai attacks and most recently the Pahalgam attack of April 2025 — fundamentally challenges the premise upon which India’s continued compliance with the IWT rests.Bilateral agreements cannot be selectively honoured. A state cannot simultaneously breach the foundational norms of inter-state conduct while demanding that its negotiating partner fulfil treaty obligations that disproportionately benefit the norm-breaker.The Treaty cannot be an island of Indian compliance within a sea of Pakistani bad faith. India’s step represents an assertion long overdue — that international agreements are a two-way street.4. Conclusion: The Indus Waters Treaty has long been celebrated as a triumph of international diplomacy.This paper has argued that such a characterisation fundamentally misrepresents what actually occurred: a negotiation process in which Pakistani intransigence was rewarded with concessions, and Indian goodwill was systematically exploited to produce an agreement that was inequitable from its inception.Nevertheless, India surrendered 80 per cent of the water, paid £62 million (approximately $2.5 billion in present value) to facilitate that surrender, accepted one-sided operational restrictions on its own territory, and has maintained scrupulous compliance for sixty-five years –including through Pakistan inflicted multiple wars and sustained sponsoring of cross-border terrorism.In return, India has received a Treaty agreed to in good faith that Pakistan uses as a tool of developmental obstruction, a ‘water war’ narrative it deploys internationally with no factual basis, and the permanent underdevelopment of vast tracts of Indian territory.India’s step is to protect its legitimate interests in the Indus Basin. Mamata Banerjee NEW DELHI: Constitutional position is unambiguous on a CM refusing to resign after her defeat in an assembly election — once the polls have been concluded and certificates issued to the elected MLAs by the EC, the outgoing House automatically stands dissolved and its successor has to be constituted with the appointment of a new CM by the governor, who invites the representative of the largest party, or an alliance, to form govt. On Tuesday, outgoing Bengal CM Mamata Banerjee stoked a controversy by claiming, in a first, that she would not resign since she has not lost the elections, disregarding TMC’s debacle and her defeat in the Bhabanipur constituency to BJP’s Suvendu Adhikari by more than 15,000 votes.Also Read | With Mamata’s nemesis Suvendu Adhikari, Amit Shah plotted her downfall Legal experts, however, are of the view that Banerjee has no option but to go and pave the way for a new govt after the tenure of the assembly expires on May 8. “Any person dissatisfied with the results can file an election petition qua individual position and constituency within 45 days of the declaration of results. Obviously, there can be no mass or mega election petitions. Equally, and obviously, the power to file such challenges in court cannot detract from the unquestionable obligation to resign and vacate CM’s chair the moment the election certificates are issued by the Election Commission. . Maybe it is a rhetorical outburst, but the legal position is clear that she has to resign (on her party being defeated in the assembly elections),” constitutional expert and senior advocate Abhishek Manu Singhvi told TOI. “This is the inexorable cycle of democracy and necessarily must be followed by all without exception. The continuance of an incumbent chief minister, after an election defeat, unfortunately will be consequentially legally void,” he added. Senior advocate Rakesh Dwivedi, an expert on constitutional laws, said that if the CM does not resign, then the governor of the state concerned has the power to dismiss her. “There is no question of two CMs under the constitutional scheme. Constitutional morality and electoral mandate make it a must for the incumbent CM to resign and make way for the political party, which secured a majority, to form govt under their representative,” he said. “The moment a new assembly is constituted, the party which won the majority in the polls will elect its representative, who will stake its claim to form govt before the governor. The governor has no option but to call the party commanding a majority in the House to form govt. If Mamata does not resign, the governor can dismiss her,” he said. NEW DELHI: Leader of opposition Rahul Gandhi on Wednesday launched a broadside against the Bharatiya Janata Party, claiming that every sixth parliamentarian out of the BJP’s 240 MPs has won through vote theft.In a social media post on X, Rahul accused the BJP of keeping institutions in its pocket.”Votes are stolen to nick seats sometimes, and sometimes entire governments. Out of the 240 BJP MPs in the Lok Sabha, roughly every sixth MP has won through vote theft. Not hard to spot them – should we call them ‘infiltrators’ in BJP lingo? And Haryana? There, the entire government is infiltrator,” Rahul said.”The institutions they keep in their pocket, the ones that tamper with voter lists and the electoral process – those are ‘remote-controlled’ themselves. Their real fear is the truth. Because if fair elections were held, they couldn’t even win 140 seats today,” he added.Rahul Gandhi’s reference to “theft of mandate” appeared to echo allegations raised by Mamata Banerjee, who claimed that “more than 100 seats were stolen” in the state, a charge the BJP has dismissed.Earlier, Mamata Banerjee alleged that the BJP “looted” more than 100 seats and termed the Election Commission “the BJP’s commission,” calling the victory “immoral” and “illegal.”This comes a day after Rahul cautioned party colleagues and other oppostion leaders against celebrating the Trinamool Congress’s defeat in West Bengal and framed the election outcome as a larger threat to Indian democracy.Without taking names, Rahul Gandhi said, “Some in the Congress, and others, are gloating about TMC’s loss. They need to understand this clearly: the theft of Assam and Bengal’s mandate is a big step forward by the BJP in its mission to destroy Indian democracy.”He urged political parties to move beyond electoral rivalries, adding, “Put petty politics aside. This is not about one party or another.
