Maybe it is a rhetorical outburst, but the legal position is clear that she has to resign (on her party being defeated in the assembly elections),” constitutional expert and senior advocate Abhishek Manu Singhvi told TOI. “This is the inexorable cycle of democracy and necessarily must be followed by all without exception. The continuance of an incumbent chief minister, after an election defeat, unfortunately will be consequentially legally void,” he added. Senior advocate Rakesh Dwivedi, an expert on constitutional laws, said that if the CM does not resign, then the governor of the state concerned has the power to dismiss her. “There is no question of two CMs under the constitutional scheme. Constitutional morality and electoral mandate make it a must for the incumbent CM to resign and make way for the political party, which secured a majority, to form govt under their representative,” he said. “The moment a new assembly is constituted, the party which won the majority in the polls will elect its representative, who will stake its claim to form govt before the governor. The governor has no option but to call the party commanding a majority in the House to form govt. If Mamata does not resign, the governor can dismiss her,” he said. There, the entire government is infiltrator,” Rahul said.”The institutions they keep in their pocket, the ones that tamper with voter lists and the electoral process – those are ‘remote-controlled’ themselves. Their real fear is the truth. NEW DELHI: A day after the Bharatiya Janata Party’s historic victory in the West Bengal assembly polls, state party president Samik Bhattacharya on Tuesday urged the administration to take strict action against those perpetrating post-poll violence.Talking to reporters, Bhattacharya warned that BJP workers found involved in such activities would be expelled from the party.”Post-poll violence will not be tolerated in any form. If anyone from our party is found involved, we will be compelled to remove them,” he said.”I would like to urge the administration to take necessary action wherever such incidents occur. This is precisely why the people of West Bengal have chosen the BJP,” he said.He also accused TMC workers of attacking their own candidates.”Two hours after the results, a TMC candidate called up Dilip Ghosh to save him. Dilip Ghosh asked him for his whereabouts, upon which he said that he was in the party office. He told the candidate that those people were with him during the elections,” he said.”The candidate said that those are TMC people but are now coming to beat him up. This was bound to happen. TMC was not a political party,” he added.Meanwhile, news agency PTI reported that a high-level meeting was held at the BJP’s Bidhannagar office, attended by central observers and senior state leaders, to discuss measures to prevent violence and maintain law and order in the post-result scenario.The discussions also focused on ensuring that there is no repeat of the violence reported after the 2021 assembly elections, when the BJP had accused the ruling Trinamool Congress of targeting its workers.The BJP has secured 207 of the 293 seats where polls were held, securing a two-thirds majority and paving the way for its first government in West Bengal. The Trinamool nominee, who came third, secured 49,586 votes, nearly three times the winning margin, exemplifying how BJP benefited from the split in votes between Congress and Trinamool.Several heavyweight Trinamool candidates, too, lost because of a similar vote split. And, in most cases, CPM played the spoilsport.For instance, Chandrima Bhattacharya would have most likely won Dum Dum North for Trinamool had CPM not fetched 38,428 votes to finish third. BJP won the seat by 26,404 votes.Aroop Biswas would have easily defeated BJP’s Papiya Adhikari in Tollyginge had CPM not taken away 30,335 votes. BJP managed to win here by 6,013 votes. Likewise, Trinamool lost Jadavpur to BJP by 27,716 votes. CPM finished third with 30,676 votes.In Uttarpara, Trinamool’s Shirshanya Bandyopadhyay lost to BJP’s Dipanjan Chakraborty by 8,685 votes. CPM was at the third place with 17,136 votes. In Chandannagar, Trinamool’s Indranil Sen lost to BJP’s Deepanjan Kumar Guha by 13,441 votes.
