NEW DELHI: Fresh allegations of massive cybersecurity lapses, data exposure and administrative failures have deepened the controversy surrounding CBSE’s On Screen Marking (OSM) system, with activists now approaching National Human Rights Commission (NHRC) for urgent intervention to protect students’ educational rights, amid continuing disrupti-ons in the board’s post-exam processes.The latest row erupted after independent developers and ethical hackers publicly claimed that sensitive stud-ent data, scanned answer sheets and question papers linked to CBSE’s digital evaluation infrastructure were exposed online because of serious security vulnerabilities. Android developer Sidharth posted on X: “Almost every single OnMark portal built by EduTek is fundamentally insecure, and CBSE is lying to you about the safety of student data. We found default passwords, URL-based RCEs, and raw MD5 hashes. BENGALURu/NEW DELHI: The Congress high command, along with chief minister-designate D K Shivakumar and caretaker chief minister Siddaramaiah, held late-night discussions in New Delhi Sunday to finalise the composition of the new Karnataka cabinet. There are plans to induct between 10 and 20 ministers in the first phase, alongside Shivakumar’s swearing-in on Wednesday.Also read | What could make or break DK Shivakumar’s reign in Karnataka A senior party functionary said the initial list is nearly ready, with some additional names still under consideration. “While 10 names have been finalised, another 10 are being discussed for oath-taking in the first round. The final list may be out Wednesday,” he added. The list of probables will be presented before AICC chief Mallikarjun Kharge and Rahul Gandhi before it is formalised. Discussions also focused on key organisational and constitutional appointments, including the KPCC president, assembly speaker and legislative council chairman. Shivakumar is said to be backing Satish Jarkiholi, H K Patil and B K Hariprasad for key organisational and cabinet roles, while Siddaramaiah is believed to be backing Hariprasad for the post of state party chief.Siddaramaiah also lobbying for inclusion of Ahinda loyalistsSiddaramaiah is also lobbying for the inclusion of his loyalists from the Ahinda bloc in the cabinet, though other netas indicated no more than 10 of his nominees are likely to be accommodated.Jarkiholi is reportedly seeking both a cabinet berth and an organisational role.The issue of deputy chief minister (DCM) posts has emerged as a major bone of contention within Congress ranks. However, Shivakumar is reportedly against the idea of DCMs, arguing it could create parallel power centres and generate unnecessary political controversy.The high command is also weighing inclusion of Siddaramaiah’s son Yathindra in the cabinet. While both state and national-level netas in the party are keen to ensure this representation to safeguard the Kuruba vote base in Karnataka, Siddaramaiah is not pushing his case. His concern being that such a move could be interpreted as nepotism.“Last time I visited the high command, Rahul Gandhi said my interest will be taken care of, and that I would be inducted into the cabinet. So, I’m hopeful. Whatever be the portfolio, I’ll be happy,” Yathindra said, adding he wasn’t harbouring any DCM ambitions.The Congress leadership also reviewed preparations for Rajya Sabha and legislative council elections scheduled for June 18. NEW DELHI: The Supreme Court has held that a rape survivor should not be harassed with repeated calls to appear in court during trial proceedings for cross examination. A bench of Justices Dipankar Datta and Satish Chandra Sharma quashed an order passed by Tripura HC which had allowed the accused’s plea to recall the survivor for examination four years after she was already cross-examined. It said the prosecutrix had already been subjected to the ordeal of deposition and cross-examination on four separate occasions before the trial court, in addition to having her statement recorded during the investigation and before the magistrate under Section 164 of the CrPC and it was harsh to recall her four years after she was cross-examined.“Directing recall would inflict further and unjustifiable hardship upon the prosecutrix. The witnesses cannot be expected to face the hardship of appearing in court repeatedly, particularly in sensitive cases. It can result in undue hardship for the victims, especially so of heinous crimes, if they are required to repeatedly appear in court to face cross-examination,” SC said. HC had passed the order to recall a survivor under Section 311 of Criminal Procedure Code on a plea filed by the accused. Noting that the application was filed after four years from the completion of her cross-examination of the prosecutrix and sufficient ground doesn’t exist for recalling the prosecutrix after such a prolonged delay, the court allowed the plea of state govt which challenged the HC order.Section 311 of the CrPC states that “any court may, at any stage of any inquiry, trial or other proceeding under this code, summon any person in attendance, though not summoned as a witness, or recall and re-examine any person already examined; and the court shall summon and examine or recall and re-examine any such person if his evidence appears to it to be essential to the just decision of the case.The court said the power conferred under Section 311 undoubtedly is wide, and such power is required to be exercised sparingly and in a judicious manner, and not arbitrarily. “Mere observation that recall was necessary for ensuring a fair trial is not enough unless there are tangible reasons to show how the fair trial suffered without recall. Recall is not a matter of course, and the discretion given to the court has to be exercised judiciously to prevent failure of justice and not arbitrarily,” it said, while citing previous orders.In this case, the prosecutrix was first examined in chief and cross-examined on June 4, 2018, followed by further cross-examination in Aug 2018. Thereafter, the prosecution filed an application under Section 311 CrPC seeking recall and re-examination of the prosecutrix. She was further examined and re-cross-examined in Aug and Nov 2019. Four years later, the accused sought to recall her in the witness box, which was rejected by the trial court but allowed by HC. NEW DELHI: Supreme Court on Monday refused to grant urgent hearing to a PIL seeking computer-based test (CBT) for the June 21 re-examination of NEET-UG, which was held nationwide on May 3 but was scrapped following allegations of paper leak.A partial-working day bench of Justices P S Narasimha and Aravind Kumar told the petitioner, RJD MP Sudhakar Singh, that similar pleas were dismissed by the SC in the past and posted the matter for hearing in July, thus negating the urgent plea for computer-based NEET-UG re-examination.When the petitioner’s counsel said CBT would minimise the chances of question paper leak, the bench said the authorities were already facing challenges in conducting the re-examination within a short timeframe.
