During the proceedings against the legality of the Special Intensive Revision (SIR), the court encouraged a focus on legal frameworks rather than political posturing or speculative assertions about BLO suicides.  NEW DELHI: Supreme Court on Tuesday told ‘Association for Democratic Reforms’ to argue within legal confines while challenging the validity of SIR of voter lists across states and without reciting snide remarks of political parties, after its counsel Prashant Bhushan referred to EC as a ‘despot’.A charged up Bhushan reeled off a set of accusations — SIR is an unprecedented exercise for de novo preparation of voter lists which is impermissible under Representation of the People Act; and an unholy hurry to complete the exercise within a short period has put BLOs under “immense mental and physical strain leading to 30 of them committing suicide”.“A lot of people see EC as a despot as it does not care for the statutory provisions, rules and regulations, and whimsically carries out whatever it feels to be appropriate,” Bhushan said.A bench of CJI Surya Kant and Justice Joymalya Bagchi immediately cautioned Bhushan not to deviate from his legal pleadings. “There is no point in making sweeping remarks against EC relying on snide remarks made by political parties (opposed to SIR). Confine your arguments to the legal issues (raised in your petition) to challenge the validity of SIR,” the bench said.Bhushan said SIR was a ruse for EC’s game plan to verify citizenship of residents in constituencies across country. He said citizenship is determined by a competent authority under ministry of home affairs and that EC has no role in this exercise.Earlier in the day, advocate Ashwini Kumar Uadhyay had alleged there were repeated instances of assault and use of criminal force to intimidate BLOs engaged in SIR work in Bengal and other states, and sought a direction from SC to allow EC to requisition the armed forces and state police for preparation of a correct voter list. NEW DELHI: Supreme Court on Tuesday asked EC to ‘sympathetically’ consider Kerala govt’s request for extending the deadline for completion of SIR of state voters list by a week beyond the conclusion of local body elections on Dec 13.A bench of CJI Surya Kant and Justice Joymalya Bagchi told Kerala govt to submit a representation to EC within 24 hours and asked EC to consider it sympathetically and pass an order within 2 days of receiving the request for extension.Kerala govt had sought deferment of SIR in the state till Dec 21. But EC, through senior advocates Rakesh Dwivedi and Maninder Singh, informed the bench that as of Nov 30, over 98% enumeration forms have been distributed and over 81% have been digitised.Dwivedi said of total 5.5 lakh govt employees, Kerala govt has allotted 25,468 govt servants as BLOs for SIR exercise and another 1.76 lakh personnel for smooth conduct of local bodies elections. Since the two sets of personnel have been assigned different kinds of work and there is no overlap, neither SIR nor local bodies elections would get impacted, he said.Kerala SEC, which is conducting the local bodies elections, also informed the bench that there had been no hiccups in the ongoing process and that on conclusion of elections on Dec 13, the personnel assigned for the purpose will be free to resume their official duties.Singh said since EC and SEC are experiencing no problem in conducting SIR and local bodies polls simultaneously, Kerala govt should not have any problem either. However, advocate Ranjit Kumar, appearing for a politician petitioner, said political workers cannot visit constituencies because of the local bodies elections. NEW DELHI: A day after a furore erupted over its decision to mandate pre-loading of state-run Sanchar Saathi app on all new smartphones, the govt softened its stance on the matter, saying that users are free to delete the application if they do not want to have it on their devices.Amidst concerns around state surveillance and violation of user privacy due to the mandated installation of the app, Communications Minister Jyotiraditya Scindia emphasised that the fears were unconfounded and added that the app was to protect the users from cyber frauds. “If you want to delete it, then delete it,” Scindia told reporters outside Parliament after the opposition Congress also raised the matter. “But not everyone in the country knows that this app exists to protect them from fraud and theft.” Dismissing the charges of the Opposition, Scindia asserted that there is no chance of snooping or call monitoring through the app. “It is our responsibility to make this app reach everyone. If you want to delete it, then delete it. If you don’t want to use it, then don’t register it. If you register it, then it will remain active. If you don’t register it, then it will remain inactive.”However, the Nov 21 order of the department of telecom (DoT) mandates the pre-install of the app under the Telecommunications (Telecom Cyber Security) Rules, 2024, and its further amendments. Not doing this will lead to action under the Telecommunications Act, 2023, the Telecom Cyber Security Rules, 2024 (as amended). Also, the govt order had clearly mandated not just the pre-installation of the app but also instructed that “its functionalities are not disabled or restricted.” So whether users will be allowed to delete it — and remove it from the device — still remains a question.However, govt sources said that the phrase — “ensure that the pre-installed Sanchar Saathi application is readily visible and accessible … and that its functionalities are not disabled or restricted” –is a direction to manufacturers, and not a restriction on users. “It simply means manufacturers must not hide, cripple or pre‑install a non-functional version of the app and later claim compliance. Nowhere it has been mentioned in the above clause that the Sanchar Saathi App cannot be uninstalled by the end user. It is up to the citizen if he wants to enable and register Sanchar Saathi Mobile App or wants to uninstall it. Users remain free to uninstall or delete the Sanchar Saathi if they do not wish to use it, as clearly clarified by the govt.”The move has already seen critics find a parallel to a similar mandate issued by the Russian govt in August requiring pre-install of state-backed messaging app, MAX. Scindia, however, denied the Opposition’s charges, and dismissed fears that it was an app for snooping. “There is no snooping on the basis of this, nor is there any call monitoring. If you want, then activate this. If you don’t want to, then don’t activate it.”The Minister claimed that Sanchar Saathi is an app and a portal on the basis of which a smartphone owner is able to protect their devices. “This is a step towards public participation. In this, people should not object, people should welcome. On the basis of this, when you buy a mobile phone, on the basis of that, whether the IMEI number is fake or genuine, you can recognise it on the basis of the Sanchar Saathi app.” The minister said that there have been more than 1.5 crore downloads of the Sanchar Saathi App, and added that to date, approximately 2.75 crore fraudulent mobile connections have been disconnected, and approximately 20 lakh stolen phones have been traced. Government clarifies users can delete the Sanchar Saathi app, intended to combat cyber fraud, despite initial mandates for pre-installation. Minister Scindia assures no snooping or call monitoring, emphasizing the app’s role in verifying IMEI numbers and tracing stolen phones. The move aims to enhance user protection against digital threats. NEW DELHI: A day after a furore erupted over its decision to mandate pre-loading of state-run Sanchar Saathi app on all new smartphones, the govt softened its stance on the matter, saying that users are free to delete the application if they do not want to have it on their devices.Amidst concerns around state surveillance and violation of user privacy due to the mandated installation of the app, Communications Minister Jyotiraditya Scindia emphasised that the fears were unconfounded and added that the app was to protect the users from cyber frauds. “If you want to delete it, then delete it,” Scindia told reporters outside Parliament after the opposition Congress also raised the matter. “But not everyone in the country knows that this app exists to protect them from fraud and theft.” Dismissing the charges of the Opposition, Scindia asserted that there is no chance of snooping or call monitoring through the app. “It is our responsibility to make this app reach everyone. If you want to delete it, then delete it. If you don’t want to use it, then don’t register it. If you register it, then it will remain active. If you don’t register it, then it will remain inactive.”However, the Nov 21 order of the department of telecom (DoT) mandates the pre-install of the app under the Telecommunications (Telecom Cyber Security) Rules, 2024, and its further amendments. Not doing this will lead to action under the Telecommunications Act, 2023, the Telecom Cyber Security Rules, 2024 (as amended). Also, the govt order had clearly mandated not just the pre-installation of the app but also instructed that “its functionalities are not disabled or restricted.” So whether users will be allowed to delete it — and remove it from the device — still remains a question.However, govt sources said that the phrase — “ensure that the pre-installed Sanchar Saathi application is readily visible and accessible … and that its functionalities are not disabled or restricted” –is a direction to manufacturers, and not a restriction on users. “It simply means manufacturers must not hide, cripple or pre‑install a non-functional version of the app and later claim compliance. Nowhere it has been mentioned in the above clause that the Sanchar Saathi App cannot be uninstalled by the end user. It is up to the citizen if he wants to enable and register Sanchar Saathi Mobile App or wants to uninstall it. Users remain free to uninstall or delete the Sanchar Saathi if they do not wish to use it, as clearly clarified by the govt.”The move has already seen critics find a parallel to a similar mandate issued by the Russian govt in August requiring pre-install of state-backed messaging app, MAX. Scindia, however, denied the Opposition’s charges, and dismissed fears that it was an app for snooping. “There is no snooping on the basis of this, nor is there any call monitoring. If you want, then activate this. If you don’t want to, then don’t activate it.”The Minister claimed that Sanchar Saathi is an app and a portal on the basis of which a smartphone owner is able to protect their devices. “This is a step towards public participation. In this, people should not object, people should welcome. On the basis of this, when you buy a mobile phone, on the basis of that, whether the IMEI number is fake or genuine, you can recognise it on the basis of the Sanchar Saathi app.” The minister said that there have been more than 1.5 crore downloads of the Sanchar Saathi App, and added that to date, approximately 2.75 crore fraudulent mobile connections have been disconnected, and approximately 20 lakh stolen phones have been traced.
