Gavai Clarifies He Never Faced Political Or Executive Pressure During His TenureReiterating the constitutional separation of powers, Gavai said the judiciary functions independently and the allegation that Collegium appointments lack transparency is “not well-founded.” He also dismissed the idea of prescribing a fixed tenure for CJIs or Supreme Court judges, noting that shorter terms do not affect judicial performance.On the role and limits of judicial intervention, Gavai cautioned against overreach. “There are limits within which judicial activism should act. As I always say, judicial activism should not turn into judicial terrorism,” he said.He emphasised that courts must step in when vulnerable citizens cannot approach the system due to socio-economic barriers, but even then, constitutional boundaries must be respected.Discussing the Supreme Court’s ruling against “bulldozer justice”, where state authorities demolished homes of individuals accused of crimes, the former CJI said the Court acted after noticing that properties were being razed without notice or legal sanction. He described such instances as clear executive overreach.”When merely because a citizen was involved in a criminal act, his house was demolished… it was like taking the law into one’s own hands,” he said, adding that families of the accused suffer unjustly. “What is the crime committed by his family? Why bulldoze their roof?” he asked, questioning the constitutional basis of collective punishment.Gavai noted that the Court allowed citizens to directly approach High Courts in demolition cases and laid down strict norms to fix accountability. Illegal demolitions, he said, could require the government to rebuild structures and recover costs from officials responsible.Reflecting on his tenure of six months and 10 days, he said, “It included summer vacation, Dussehra vacation and Diwali vacation. But I could perform whatever I had anticipated and planned out. Yesterday we made a statement, you would have seen that, regarding the arbitrary detention of an Indian citizen from Arunachal Pradesh, who was holding a valid passport and was transiting through Shanghai International Airport on onward travel to Japan,” the MEA spokesperson said.”We want to say that Arunachal Pradesh is an integral and inalienable part of India, and this is a fact that is self-evident. No amount of denial by the Chinese side is going to change this indisputable reality. At the same time, I said that we did take up this matter; we did make a strong demarche with the Chinese side, both in Beijing and Delhi, when the incident took place,” he added.The ministry further said that such actions are “most unhelpful towards efforts” of normalistaion made by both sides.”Let me reiterate, maintenance of peace and tranquillity in the border regions is a prerequisite for the continued and overall development of India-China bilateral relations. Our position in this regard has always been very clear and consistent. Since October 2024, both sides have worked closely to maintain peace and tranquillity in the border regions. It is on this basis that progress with focus on people-centric engagements, progress has been made,” Jaiswal said.”Arbitrary actions by China involving an Indian citizen from Arunachal Pradesh are most unhelpful towards efforts being made by both sides to build mutual trust and understanding and gradually move towards normalisation of bilateral relations,” he added.This comes days after Prema Wangjom Thongdok, an Indian passport holder from Arunachal Pradesh, was reportedly detained in transit despite being eligible for visa-free passage, a facility offered to nationals of all countries for up to 24 hours under Chinese regulations. India said the incident not only lacked justification but also breached norms governing international movement.”The issue of detention has been taken up strongly with the Chinese side. Chinese authorities have still not been able to explain their actions, which are in violation of several conventions governing international air travel,” Jaiswal said, adding that the “actions by the Chinese authorities also violate their own regulations that allow visa-free transit up.”Meanwhile, China on Tuesday rejected allegations of harassment levelled by Indian national Prema Wangjom Thongdok, who hails from Arunachal Pradesh, and stated that “the lawful rights and interests of the person concerned were fully protected and no compulsory measures were taken on her”.Wangjom Thongdok had narrated her “long ordeal” and stated that she faced harassment from Chinese immigration officials at Shanghai Pudong Airport, who “mocked and raised questions” over her Indian citizenship and noted that her 18-hour ordeal came to an end with the help of officials from India’s missions in Shanghai and Beijing.India issued a strong demarche to the Chinese side, both at the Embassy in New Delhi and the Foreign Ministry in Beijing, over the incident.Responding to queries on the incident during a media briefing, Chinese Foreign Ministry spokesperson Mao Ning again repeated Beijing’s stance, which has always been categorically rejected by India. NEW DELHI: A Delhi court on Wednesday sent six persons, to three-day police custody after a protest against air pollution at the India Gate turned violent on Sunday.The police alleged that 10 police personnel were allegedly attacked with pepper spray during the protest over poor air quality. The police also told the court that they are probing naxal links as the protesters raised pro-naxal slogans. Delhi Air Pollution Protest At India Gate Turns Violent Amid ‘Madvi Hidma Amar Rahe’ SlogansDCP (New Delhi) Devesh Mahla, appearing before Judicial Magistrate First Class Aridaman Singh Cheema of Patiala House Courts seeking seven days of police custody of the six accused said that Madvi Hidma (dead Maoist commander) killed 76 CRPF personnel and the accused were raising slogans for him”Some of the accused persons blocked Man Singh Road on November 9. There is an FIR in that regard as well. So, it won’t be right to say this is the first time they’re involved,” said the police officer. Total 23 students were arrested and two FIRs were lodged. Meanwhile, alleging torture in police custody, the accused have moved bail applications, which will be heard after three days.The FIRs were lodged under charges related to assault, obstruction of public servants and outraging the modesty of women of the Bharatiya Nyaya Sanhita.The prosecution told the court that Radical Students Union (RSU) is a banned organisation which it was the frontal organisation and the accused have praised them on social media”Free speech is allowed but there are restrictions to free speech. We found three pepper sprays. We need to send mobile phones for examination at FSL,” said the police officer. While 17 protesters were arrested in connection to the FIR lodged at Parliament Street police station, six were arrested in the case registered at Kartavya Path police station.Those named in the FIR include atleast seven Delhi University students – six reportedly associated with the Bhagat Singh Chhatra Ekta Manch (BSCEM) and one with Himkhand, an environmental research and action collective.Opposing the prosecution’s submissions, counsel for the accused told the court that none of them were a part of any banned organisation and the allegations are vague, misleading. “Slogans can be anti-establishment but these can’t be a ground for police custody.
